GAFFERY IV, Parking Division Manager Development and Resource Management Department SUBJECT ..Title BILL - (For Introduction) Amending Sections 14-2601, 14-2602, 14-2603, 14-2604, 14-2605 and Repealing Sections 14-2606 and 14-2607 of the Fresno Municipal Code, Relating to "Semi" Truck and Trailer Parking ..Body RECOMMENDATION Staff recommends City Council adopt the Bill (For Introduction) amending Sections 14-2601, 14-2602, 14-2603, 14-2604, 14-2605 and Repealing Sections 14-2606 and 14-2607 (Article 26) of the Fresno Municipal Code, Relating to "Semi" Truck and Trailer Parking. EXECUTIVE SUMMARY Article 26 of the Fresno Municipal Code, as currently written, relies on Code Enforcement to issue administrative citations for "semi" trucks parked overtime in the public right-of-way. The proposed changes move citation responsibility to the Parking Division. A violation of Article 26 is more effectively enforced by Parking Controllers issuing parking citations and is a more efficient use of City resources. The proposed changes also include a number of text simplifications, and removal of outdated language. BACKGROUND Citizens regularly call the Parking Division regarding "semi" trucks parked in their neighborhoods blocking views, as well as vehicles and trailers left on the streets for extended periods of time. City Divisions are also negatively impacted when repairing street lights, sweeping streets, and picking up trash due to oversized vehicles impeding access to the curb. Key changes include removal of duplicate language in Article 26, and changing violations of Article 26 from an administrative citation to a parking violation. Additional changes include the repeal of sunsetted sections 14-2606 and 14-2608 for added clarity. ENVIRONMENTAL FINDINGS Staff has determined that amendment of Article 26 is exempt under CEQA Guideline 15301 Class 1, which provides exemption for the operation, repair, maintenance, permitting, leasing, licensing, or other minor alteration of existing public structures and facilities, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The proposed amendment of Article 26 is within the Class 1 exemption because it involves negligible or no expansion of use. None of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, section 15300.2 apply to this project. LOCAL PREFERENCE Local preference was not considered because this does not include a bid or award of a construction or services contract. FISCAL IMPACT The proposed changes will generate additional parking citation revenue to the City's General Fund. Attachment: Ordinance FMC Semi Truck and Trailer Parking
