Approve a Caltrans Utility Agreement (No. 06-1398.011) for City staff to design and inspect the utility relocations of City infrastructure associated with the State Route 99 Relocation Project 2. ***RESOLUTION - 24th amendment to Annual Appropriations Resolution (AAR) No. 2014-95 appropriating $270,100 for design and inspection costs for the State Route 99 Utility Relocation Project in FY2015 (Requires 5 affirmative votes) ..Body RECOMMENDATION Staff recommends the City Council take the following actions: 1. Authorize staff to enter into a Utility Agreement with the California Department of Transportation (Caltrans) for City staff to design and inspect the utility relocations of City infrastructure being impacted by the State Route 99 Relocation Project. 2. Adopt the 24th Amendment to the Annual Appropriation Resolution No. 2014-95 to appropriate $270,100 for design and inspection costs for the State Route 99 Utility Relocation Project in FY 2015. EXECUTIVE SUMMARY Caltrans is developing project documents to relocate a section of State Route 99, between Clinton Avenue and Ashlan Avenue in order to make room for the future High Speed Rail Project. Through the project development process Caltrans has identified several City utilities that are in conflict with the proposed improvements and will need to be relocated with the City streets. City staff and Caltrans have reached an agreement in which Caltrans will reimburse the City for all design and inspection costs for this work. BACKGROUND Caltrans, as part of their long term plans and now accelerated because of the future High Speed Rail Project, is developing construction documents to relocate a section of State Route 99, between Clinton Avenue and Ashlan Avenue. The State Route 99 Relocation Project consists of reconstruction of the Clinton Avenue interchange and the Ashlan Avenue overhead structure, closure of three partial interchanges and realignment of local and frontage roads. Through the project development process Caltrans has identified several City utilities that are in conflict with the proposed improvements and will need to be relocated along with the City streets. Once construction is complete, the City's existing sewer and water mains will be replaced with new infrastructure. In order for the City to be reimbursed for design and inspection costs associated with the relocation work, Caltrans has provided the attached utility agreement. The City of Fresno Design Services Section will develop the utility relocation plans per City standards for Caltrans to use in construction. During the construction phase of the project, City staff will inspect the new improvements similar to other capital improvement and development projects. The City Attorney has reviewed and approved the Caltrans Utility Agreement No. 06-1398.011. ENVIRONMENTAL FINDINGS The utility relocation work for this agreement falls under the environmental clearance of the Caltrans project to relocate State Route 99. No environmental findings are required for this agreement. LOCAL PREFERENCE Local preference was not considered because the City's design and inspection service does not include a bid or award of a construction or services contract. FISCAL IMPACT The City of Fresno will be reimbursed by Caltrans for 73% of all costs associated with the design and inspection services associated with the utility relocations.
