Award a construction contract to Dave Christian Construction, Inc. of Fresno, California in the amount of $1,124,186 for the Herndon Avenue Overlay from Blackstone Avenue to West Avenue ..Body RECOMMENDATION Staff recommends that the City Council adopt a finding of Categorical Exemption per staff determination, pursuant to Class 1 Section 15301(c) of the CEQA Guidelines and award a contract to Dave Christian Construction, Inc. of Fresno, California for the Herndon Avenue Overlay from Blackstone Avenue to West Avenue and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City. EXECUTIVE SUMMARY The City of Fresno seeks to rehabilitate Herndon Avenue between Blackstone Avenue and West Avenue. The project will consist of asphalt grinding, asphalt overlay, replacing traffic signal loop detectors, signage, striping and construction of pedestrian curb ramps. Staff recommends Council award a construction contract to Dave Christian Construction Company Inc. of Fresno, California in the amount of $1,124,186 as the lowest responsive and responsible bidder for the Herndon Avenue Overlay Project from Blackstone Avenue to West Avenue. BACKGROUND Herndon Avenue Overlay is a regional bid project under the Regional Surface Transportation Program (RSTP). The project will rehabilitate Herndon Avenue in both the east and westbound directions, over a two (2) mile span, between Blackstone Avenue and West Avenue. The project will grind the existing asphalt pavement and install two inches of new asphalt pavement, install new traffic signal loop detectors, signage and striping as well as construct new pedestrian curb ramps conforming to current American with Disabilities Act (ADA) standards. Construction documents and specifications were prepared and a Notice Inviting Bids was published in the Business Journal on March 30, 2015, and posted on the City's website. Advertising efforts resulted in the participation of eight (8) prospective bidders. Ultimately, six sealed bid proposals were received and opened in a public bid opening on April 21, 2015, with the bids ranging from $1,124,186 to $1,335,845. Dave Christian Construction Company Inc. of Fresno, California, submitted the lowest bid in the amount of $1,124,186 and is considered the lowest responsive and responsible bidder. The bid results were posted on May 11, 2015, on the City of Fresno Purchasing Division web page. Staff recommends award of a construction contract to Dave Christian Construction Company Inc. of Fresno, California in the amount of $1,124,186 for the Herndon Avenue Overlay Project from Blackstone Avenue to West Avenue and to authorize the Public Works Director, or his designee, to sign and execute the standardized contract on behalf of the City. ENVIRONMENTAL FINDINGS Staff has performed a preliminary environmental assessment of this project and has determined that it falls within the Class 1 Categorical Exemption set forth in Section 15301(c) of the CEQA Guidelines which exempts the repair, maintenance or minor alteration of existing structures or facilities because project involves grinding the deteriorated top two (2) inches of asphalt pavement and replacement with two (2) new inches of asphalt. Furthermore, Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. Staff recommends that the Council, based on its own independent judgment, adopt a finding of Categorical Exemption per staff determination, pursuant to Class 1 Section 15301(c) of the CEQA Guidelines for the Herndon Avenue Overlay project from Blackstone Avenue to West Avenue. LOCAL PREFERENCE Local preference was not implemented based on conditions of the Federal Regional Surface Transportation Program Grant. FISCAL IMPACT The project is located in Council District 2. The overall cost of project is $1,460,705 and is funded by $1,410,705 in Federal RSTP grant funds and $50,000 in Prop 111 funds. The project will not have any impact to the General Fund. Of the overall budget of the project, $1,236,605 will be used for the construction contact award.
