Magdaleno in the amount of $36,000 for the construction of Roy Avenue and Almy Avenue street improvements near Fig Avenue. 2. Authorize the Public Works Director, or his designee, authority to sign all documents necessary to complete the transaction. ..Body RECOMMENDATIONS Staff recommends that the City Council: 1. Approve the acquisition of 9,164 square feet of right-of-way for public street purposes from property owned by Maria C. Magdaleno in the amount of $36,000. 2. Authorizes the Public Works Director, or his designee, to sign all documents necessary to complete the transaction. EXECUTIVE SUMMARY The City of Fresno is utilizing Community Development Block Grant (CDBG) funds to improve Roy Avenue, Almy Avenue and Clara Avenue near Fig Avenue. Additional street right-of-way is needed on the east end of Roy Avenue and east of Fig Avenue to install sidewalks and an ADA compliant ramp. Staff met with the property owner and negotiated a purchase price at the appraised value of $32,100 for the additional 9,164 square feet of right-of-way at $3.50 a square foot. In addition to the land value there is a cost to cure 238 lineal feet of chain link fence to be replaced at an estimated cost of $3,808. The total appraised value for the acquisition including cost to cure is $36,000. BACKGROUND The adopted budget for FY2016 includes improvements to Almy Avenue and Roy Avenue near the intersection of North Avenue and Fig Avenue. This area was developed in the County many years ago and most of the homes do not have curb and gutter. The project will include new curb, gutter, sidewalk, street lights, and pavement on Almy Avenue and Roy Avenue between Fig Avenue and Clara Avenue. Work will also be performed on Clara Avenue between Almy Avenue and North Avenue. Habitat for Humanity built several new affordable homes on Clara Avenue a few years ago and has constructed a small City park on Almy Avenue. The City's street reconstruction project and the new park will significantly improve the appearance and safety in a neighborhood that has deteriorated and has several blighted properties. ENVIRONMENTAL FINDINGS It was on August 27, 2015, the Council approved the preliminary environmental assessment of this project (EA14-023) determined that it falls within the Categorical Exemption set forth under Section 15301 (Class 1/Existing Facilities) and Section 15303 (Class 3/New Construction or Conversion of Small Structures) of the California Environmental Quality Act Guidelines. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the California Environmental Quality Act Guidelines, section 15300.2 apply to this project. LOCAL PREFERENCE Local preference was not considered because the acquisition of this property does not include a bid or award of construction or services contract. FISCAL IMPACT The $1.8 million Roy Avenue and Almy Avenue reconstruction project in Council District 3 is being funded with CDBG and gas tax dollars in accordance with the adopted budget. There is no impact on the General Fund. Funds were approved for the project as part of the adopted FY2016 budget. Attachments: Exhibit A APN Vicinity Map
