REPORT TO THE CITY COUNCIL FROM: TJ MILLER, Interim Director Personnel Services Department BY: JENNIFER MISNER, Assistant Director Personnel Services Department SUBJECT ..Title ***RESOLUTION-Adopt the 5th Amendment to the Position Authorization Resolution (PAR) No. 2022-153 adding one (1) permanent part time position of Senior HR/Risk Analyst in the Personnel Services Department (Subject to Mayor's Veto) ..Body RECOMMENDATION Staff recommends that Council approve the adoption of the 5th Amendment to the Position Authorization Resolution (PAR) No. 2022-153, adding one (1) permanent part-time position of Senior HR/Risk Analyst in the Personnel Services Department. EXECUTIVE SUMMARY The Personnel Services Department (PSD) conducts complex personnel investigations as required by law when it receives complaint of harassment, discrimination, and/or retaliation. PSD employs two Senior Human Resources/Risk Analysts to coordinate and conduct the necessary processes associated with the time sensitive requests. PSD contracts with several legal firms and investigative services agencies and receives assistance from the City Attorney's Office to assist with addressing the significant caseload of investigations. The current resources allocated to investigations has not been able to keep up with the complaints received. The complexity of investigations associated with various regulatory agencies and their respective laws and regulations in addition to a rapidly growing workforce has contributed to an increase in complaints. Staff recommends the approval of a Permanent Part-Time (PPT) Senior Human Resources/Risk Analyst to assist in expediting the current caseload and to limit potential liability to the City arising out of processing delays. BACKGROUND The City of Fresno is required by state and federal law to conduct a timely, thorough, and independent investigation when it receives a complaint of harassment, discrimination, and/or retaliation. These investigations are generally complex in nature and take a significant amount of time to conduct as they involve complex legal regulations from various oversight agencies and adherence to the City's administrative procedures. The Personnel Services Department currently has two (2) full time Senior Human Resources/Risk Analyst positions dedicated to the coordination, investigation and procedural review and completion of these requests. Additionally, PSD also contracts with several legal firms and investigative services agencies and receives assistance from the City Attorney's Office to address the significant caseload of investigations. These resources have not been sufficient to keep pace with the growing demand for investigations associated with the City's workforce of over 4,000 employees. Staff recommends Council approve the addition of a Permanent Part-time Senior Human Resources/Risk Analyst position funded at 0.6 FTE to assist with the continuous influx of requests and to ensure the timely completion of investigations as well as limit potential future liability for the City caused by delays in processing. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a "project" and is therefore exempt from the California Environmental Quality Act requirements. LOCAL PREFERENCE Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.
