Award a construction contract in the amount of $998,000 for the Base Bid plus all two (2) Add Alternates, with Estate Design and Construction of Los Angeles, California as the lowest responsive and responsible bidder for the Vinland Park Futsal and Pickleball Courts Project. ..Body RECOMMENDATIONS Staff recommends City Council (1) adopt a finding of Categorical Exemption per staff's determination pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines, for the Vinland Park Futsal and Pickleball Courts Project (2) award a construction contract in the amount of $998,000 for the Base Bid plus two (2) Add Alternates, to Estate Design and Construction of Los Angeles, California as the lowest responsive and responsible bidder for the Vinland Park Futsal and Pickleball Courts Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City). EXECUTIVE SUMMARY The Capital Projects Department (CPD) seeks to award a construction contract to Estate Design and Construction following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $998,000 for the Base Bid plus two (2) Add Alternates for the Vinland Park Futsal and Pickleball Courts Project. The scope of work includes the construction of four pickleball courts, one futsal court, shade structure, drinking fountain, picnic tables and benches. The Project will be funded utilizing Fiscal Year 2025 appropriations from American Rescue Plan Act (ARPA) and Measure P, Category 1 funding. BACKGROUND Vinland Park is located on the northwest corner of Gettysburg and Woodrow Avenues. The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to construct four pickleball courts, one futsal court, shade structure, drinking fountain, picnic tables and benches. The Project will support the growth of the pickleball and futsal community in the surrounding area and will cultivate an environment that promotes health and social interaction. On June 22, 2023, Council approved a Consultant Services Agreement with Quad Knopf, Inc., to develop construction drawings for Vinland Park Futsal and Pickleball Courts Project. CPD now seeks to award a construction contract to construct the proposed improvements. A Notice Inviting Bids was advertised and published on the City's website, Planet Bids and the Business Journal on September 20, 2024. The Project plans and specifications were distributed to 41 prospective bidders and posted at Eleven (11) Building Exchanges. Five (5) sealed bid proposals were received and publicly opened on October 22, 2024, with bid amounts for the Base Bid plus all two (2) add alternates ranging from $998,000 to $1,587,992. Estate Design and Construction of Los Angeles, California was determined to be the lowest responsive and responsible bidder. The bids will expire on December 25, 2024. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project. This contract is subject to the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound. Staff recommends that Council adopt a finding of Categorical Exemption pursuant to section 15061(b)(3) of the California Environmental Quality Act Guidelines, for the Vinland Park Futsal and Pickleball Courts Project, and award a construction contract in the amount of $998,000 for the Base Bid plus all two (2) Add Alternates, to Estate Design and Construction of Los Angeles, California as the lowest responsive and responsible bidder for the construction of the Vinland Park Futsal and Pickleball Courts Project, and authorize the Capital Projects Director or designee to sign a standardized construction contract on behalf of the City. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA and Measure P, Category 1 funding. The City Attorney's Office has reviewed and approved the contract documents as to form. ENVIRONMENTAL FINDINGS Staff has reviewed the scope and nature of this Project and determined that the Project is categorically exempt from the requirements of CEQA pursuant to Section 15061(b)(3). This exemption applies based on the analysis provided by Staff that there is no possibility that the Project activities would have a significant impact on the environment. LOCAL PREFERENCE Local Preference was not implemented because of federal ARPA funding. FISCAL IMPACT The Vinland Park Futsal and Pickleball Courts Project is in Council District 4 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA and Measure P, Category 1 funding.
