(Council District 5) ..Body RECOMMENDATION Staff recommends City Council approve the First Amendment to Consultant Services Agreement Provost & Pritchard Consulting Group (Consultant) of Fresno, California, to extend the term of the contract from December 31, 2024, to December 31, 2026, without changing the compensation of the Agreement, for the engineering design services for the Wellhead Treatment Improvements at Pump Station 102A (PS 102A) Project (Project) and authorize the Capital Projects Director or designee to sign the First Amendment to Consultant Services Agreement on behalf of the City of Fresno. EXECUTIVE SUMMARY On June 10, 2022, the Department of Public Utilities (DPU) entered into a Consultant Services Agreement with Provost & Pritchard Consulting Group of Fresno, California, in the amount of $215,986 with a contingency amount not to exceed $20,000 to provide engineering design services for the Project. Due to a procurement requirement, an extension to the Consultant Services Agreement is now necessary to retain the Consultant's services through project completion. Funding for this project is included in the Fiscal Year 2025 Water Enterprise Fund. BACKGROUND The DPU Water Division maintains a water supply network consisting of more than 260 municipal groundwater production wells. The groundwater contaminant 1,2,3-trichloropropane (TCP), has been detected in approximately 100 of the City's 260 wells. TCP has been used mainly as a solvent and extracting agent and is known to be a by-product in the manufacture of specific soil fumigants known as nematicides. Extensive use of these fumigants is believed to have resulted in the migration of TCP into local groundwater supplies. To date, approximately 33 of the City's municipal groundwater production wells exceed the regulatory maximum contaminant level for TCP. Of these wells, approximately 26 are currently non-operational due to the absence of TCP treatment facilities at the corresponding well site. Implementation of wellhead treatment facilities at the impacted well sites is necessary to resume operation of the groundwater production wells and ensure appropriate levels of service are maintained. On June 10, 2022, DPU entered into a Consultant Services Agreement with Provost & Pritchard Consulting Group in the amount of $215,986 with a contingency amount not to exceed $20,000 to provide engineering design services for the Project. To date, the Consultant has evaluated the groundwater quality data and prepared a Basis of Design Report for the Project. The Consultant also prepared an environmental assessment and is nearly finished with the preparation of plans and specifications for construction of the proposed improvements. Remaining services to be provided by the Consultant include the acquisition of all related permits and engineering support during bidding and construction. The TCP treatment vessels proposed in the construction will require a minimum of six months lead time for fabrication, and as such, must be procured prior to bidding the wellhead treatment plans. Therefore, the Consultant will be placed on hold when the plans are completed. As a result, construction will be delayed, and the Consultant Services Agreement will need to be extended to provide for the required support during bidding and construction phase. Staff now recommends City Council approve the First Amendment to the Consultant Services Agreement with Provost & Pritchard Consulting Group, Inc. of Fresno, California, to extend the term of the Agreement from December 31, 2024, to December 31, 2026, and authorize the Capital Projects Director or designee to sign the First Amendment to Consultant Services Agreement on behalf of the City of Fresno. The Project will be funded utilizing appropriations from the Water Enterprise Fund adopted in the Fiscal Year 2025 Budget. The City Attorney's Office has reviewed and approved the First Amendment to the Consultant Services Agreement as to form. ENVIRONMENTAL FINDINGS An Amendment to the Consultant Services Agreement does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines 15378. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing Consultant Services Agreement. FISCAL IMPACT The engineering design services for the Wellhead Treatment Improvements at Pump Station 102A Project is located in Council District 5 and will have no impact to the General Fund. Funds for this project were previously encumbered and no additional funding is needed as the subject amendment is strictly for a term extension.
