(Labor Compliance Monitoring ON-Call Services - Bid File 12501061) 1. Approve a five-year Compliance Monitoring Services Agreement with Labor Consultants of California, a Sole Proprietorship based in Hanford, California, with a not to exceed spending authority of $350,000. 2. Approve a five-year Compliance Monitoring Services Agreement with NV5, Incorporated based in Fresno, California, with a not to exceed spending authority of $350,000. ..Body RECOMMENDATION Staff recommend that City Council approve two (2) On-Call Labor Compliance Monitoring Services Agreements between the City of Fresno and 1) Labor Consultants of California and 2) NV5 Inc. for construction projects and contracts. Each agreement is for a five-year term. Reimbursement will be based on hours worked at the rates specified in the respective Schedule of Fees, not to exceed $350,000 per consultant over the term with no guarantee that the full amount will be authorized. EXECUTIVE SUMMARY On December 18, 2024, the City released a Request for Proposal (RFP #12501061) seeking proposals for Labor Compliance Monitoring Services. The Information Services Department received six (6) proposals and after a thorough review selected two firms to perform these services on an on-call basis. Staff recommend the City Council approve the two agreements, each for five-year terms, to Labor Consultants of California and NV5, Inc. Reimbursement will be based on hours worked at the rates outlined in the respective Schedule of Fees, with a spending authority not to exceed $350,000 per consultant over the term. There is no guarantee that the full amount will be authorized. Funding for this agreement will come from existing appropriations in the Information Services Department budget. BACKGROUND The Information Services Department (ISD) occasionally handles construction projects and contracts classified as Public Works Improvement, which require labor compliance monitoring. Examples include the citywide Access Door Control Projects and anticipated fiber/broadband projects. In response to the increased work done on this project and potential future projects, staff solicited a Request for Proposal (RFP #12501061) for Labor Compliance Monitoring Services. The Information Services Department released the RFP on December 18, 2024, and received six proposals by the January 15, 2025, deadline. Respondents included Ghirardelli Associates, Labor Consultants of California, NV5, Inc., QK, Inc., and The Solis Group, and Willdan. Upon the committee's reviews and discussions of the submissions, each firm was ranked and evaluated. Two firms, Labor Consultants of California and NV5, Inc., were identified as the most qualified consultants for these services. Staff recommend City Council approve both agreements, each for an initial five-year term with the option of up to five additional one-year extensions at the City's discretion. Reimbursement will be based on hours worked, billed at the rates specified in each consultant's Schedule of Fees, with a not to exceed limit of $350,000 per consultant over the contract term. There is no guarantee that the full amount will be authorized. ENVIRONMENTAL FINDINGS Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA. LOCAL PREFERENCE Local preference was taken into consideration for this contract. NV5, Inc. is a local business, as defined by the Fresno Municipal Code but Labor Consultants of California did not receive local preference. FISCAL IMPACT Funds for this agreement will come from existing appropriations in the Information Services Department budget.
