Parks Community Center: 1. Approve a Third Amendment for Consultant Services with Kleinfelder, Inc. for Environmental Engineering Services to extend the term of the agreement for no additional cost through February 28, 2026, to complete services for the Maxie L. Parks site located at 2165 South Elm Street, Fresno, CA 93706. 2. Authorize the City Manager or designee to execute the agreement on behalf of the City of Fresno. ..Body RECOMMENDATION Staff recommend that the City Council approve a Third Amendment for Consultant Services with Kleinfelder to extend the term of the agreement for no additional cost through February 28, 2026 to complete environmental engineering services, and authorize the City Manager or designee to sign all related documents on behalf of the City. EXECUTIVE SUMMARY The City of Fresno has been working with Kleinfelder to provide environmental engineering services to respond to Central Valley Regional Water Quality Control Board's (RWQCB) requirements associated with the Maxie L. Parks site located at 2165 South Elm Street. This amendment will extend the term of the agreement to enable the completion of the environmental engineering services. BACKGROUND On October 20, 2023, the City of Fresno entered into a consultant agreement with Kleinfelder, Inc. for an additional assessment of the Maxie L. Parks site based on the RWQCB recommendations. The additional assessment involved installing permanent vapor monitoring points and conducting soil testing. On November 9, 2023, on-site vapor monitoring was completed. On November 10, 2023, Kleinfelder contacted the City to communicate that while two of the nine vapor monitoring points were sampled, seven other vapor monitoring points were unable to be sampled as they were no longer available and/or viable. Based on this information, the City met with the RWQCB to discuss the most appropriate means to collect the information requested. On January 11, 2024, PARCS executed a first amendment to continue and complete the additional services. On January 30, 2024, Kleinfelder and their subcontractor Confluence Technical Service conducted a soil vapor probe installation at the site as approved by the RWQCB on January 18, 2024. The installation was comprised of the triple-nested vapor monitoring probes. On February 15, 2024, Confluence Environmental Services conducted soil vapor sampling that were analyzed by USEPA Modified Method O-15-ll by ASTM Method D1946 by Eurofins Air Toxics Laboratory. On April 3, 2024, the City received the results of the additional on-site assessment of constituents of concern. The results showed that concentrations of benzene measured were below the residential environmental screening limits (ESL) in both soil and vapor samples. Based on the testing findings, historical analysis, and analysis of groundwater gradient, the consultant concluded that benzene in soil vapor did not originate at the Former Imperial Laundry site. On April 9, 2024, the City of Fresno submitted the results of the additional on-site assessment as requested by the RWQCB. On July 25, 2024, Council approved a second amendment to the consultant services agreement for an amount not to exceed $85,200 to cover costs associated with regulatory negotiations and research, revisions to the feasibility study, and development and implementation of a remedial action work plan. The RWQCB has reviewed the results and has responded in a letter dated February 14, 2025 that no further assessment of vapor intrusion at the site is required. The RWQCB has directed the City to prepare a work plan to decommission all vapor probes, monitoring well IL0MW-1, and any other infrastructure related to site assessment. The purpose of the third amendment is to extend the term through February 28, 2026 and amend the scope of work to complete the decommissioning and other related tasks. The amendment does not add any additional funding. ENVIRONMENTAL FINDINGS In accordance with California Environmental Quality Act (CEQA) Guidelines Section 15378, site assessment for the purpose of evaluating environmental conditions does not qualify as a "project" for the purposes of CEQA. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to a previous consultant agreement. FISCAL IMPACT Funding for this project is included in the City's Adopted Fiscal Year 2025 budget from Measure P Expenditure Category 1.
