RECOMMENDATION
Staff recommends that City Council adopt the 7th Amendment to the Annual Appropriation Resolution No. 2026-159 to reappropriate the Cal OES Agreement A211006364 award of $31,700 to the FY 2027 Fire Department budget.
EXECUTIVE SUMMARY
The Fire Department participated in a solicitation for Type II Hazardous Materials Apparatus as part of the Cal OES Haz Mat program. Fresno Fire was awarded one apparatus along with Agreement A211006364 to cover the costs of training personnel to staff the apparatus. Cal OES last revised Agreement A211006364 with Amendment Nine, which brought the total award to $775,000 between October 1, 2021, and June 30, 2026.
BACKGROUND
Cal OES's Fire, Rescue, and Haz Mat Program developed a Regional Hazardous Materials (Haz Mat) Program modeled after the Cal OES Fire Engine Program. Its purpose is to strengthen statewide response capability and close the gaps in areas with limited or no Haz Mat resources by rail. As part of this effort, Cal OES distributed twelve Type 2 Haz Mat Emergency Response Vehicles, each equipped with all FIRESCOPE-required Type 2 standardized equipment.
In addition, Cal OES coordinates all required training for personnel who are not trained to the Specialist level for a FIRESCOPE Type 2 Haz Mat Response as well as covers the cost of the training. In October 2021, Agreement A211006364 was entered into between Fresno Fire Department and Cal OES for $100,000 to cover the cost of the necessary backfill for those staff attending required training. There have been nine amendments increasing the amount of the agreement: #1 August 2022 added $50,000; #2 March 2023 added $50,000; #3 August 2023 added $75,000; #4 October 2023 added $100,000; #5 November 2023 added $75,000; #6 April 2024 added $50,000; #7 October 2024 added $150,000; #8 January 2025 added $50,000; and #9 October 2025 added $75,000 bringing the total amended agreement amount to $775,000. Amendment nine was approved and appropriated in FY 2026 with the intent that all funding would be fully expended by the end of FY 2026. However, the final training approved for reimbursement through this agreement occurred June 17th-22nd, 2026 creating expenses that will post to the FY 2027 Fire Department budget. Therefore, $31,700 for amendment nine needs to be reappropriated in order to correctly record expenses and close out the agreement.

LOCAL PREFERENCE
Local preference was not implemented because this item is not an award of a construction or services contract.
FISCAL IMPACT
