Authorize the Chief of Police to enter into a Memorandum of Understanding (MOU) with California State University of Fresno, Foundation to prepare a pre-and post-Local Evaluation Report in the amount of $75,000 over the five-year performance period of the grant. ..Body RECOMMENDATION Staff recommends that Council authorize acceptance of $6,000,000 in grant funding from the State of California, Board of State and Community Corrections (BSCC), allowing the Chief of Police to enter into and execute the agreement and any amendments or modifications, adopt a Resolution of the Council of the City of Fresno, authorizing acceptance of $6,000,000 from the California Board of State and Community Corrections (BSCC) for the Fresno Police Department’s Proposition 64 Public Health and Safety Cohort 4 grant, and adopt the 14th Amendment to AAR No 2026-159 to appropriate $884,700 funding into the FY 2027 budget. The remaining funds will be utilized in future fiscal years. EXECUTIVE SUMMARY The City of Fresno has been awarded grant funds of $6,000,000 from the State of California, Board of State Community Corrections (BSCC) and proposes the formation of Fresno’s Cannabis Enforcement & Compliance Unit (CECU), a three detective team supported by district overtime to reduce illegal cannabis operations linked to violence, fires, and unsafe living conditions. The initiative targets unlicensed cultivation, manufacturing, distribution, and online sales that contributed to the killings of several of Fresno’s Youth. CECU will use intelligence driven strategies, digital forensics through the Multi-Agency Digital (MAD) Lab, and coordinated inspections to shut down illegal sites, seize firearms, and protect consumers. The project strengthens public outreach, improves interagency coordination, and enhances data driven enforcement. The grant period is from July 1, 2026 to June 30, 2031. In Year 2 of the grant, three full-time position sworn police officers will be moved to this grant from another state grant ending June 30, 2027. BACKGROUND The Proposition 64 Public Health and Safety Grant Program was established in 2016 through the voter-approved Control, Regulate and Tax Adult Use of Marijuana Act. This cohort of awards was made in a variety of size-based categories with all projects addressing one or more of four cannabis related focus areas: public safety/enforcement, youth prevention/intervention, public health, or environmental impacts.   While the BSCC initially made $125 million available through this funding cycle and prioritized applications addressing illicit cannabis enforcement pursuant to Senate Bill 141, the Board leveraged anticipated Fiscal Year 2026-27 funding and other available resources to fully fund all eligible applicants. As part of the 2025 Budget Act, eligibility for grant funding was expanded to support more local jurisdictions in addressing cannabis-related public safety challenges. Under the updated criteria, a local government is eligible for funding if it permits retail cannabis storefront sales or, for jurisdictions with populations of 10,000 residents or fewer, allows cannabis delivery serving both medicinal and adult-use consumers. Prior grantees that used funds for enforcement activities eradicated nearly one million illegal cannabis plants, seized 295 illegal firearms, and disrupted illicit cannabis operations that threatened public safety and undermined California’s regulated market With the grant funding, the City of Fresno Police Department (FPD) proposes the formation of Fresno’s Cannabis Enforcement & Compliance Unit (CECU), a three detective team supported by district overtime to reduce illegal cannabis operations linked to violence, fires, and unsafe living conditions. The initiative targets unlicensed cultivation, manufacturing, distribution, and online sales that contributed to the killings of several of Fresno’s Youth. California State University Fresno, Foundation (CSUFF) will be contracted to provide a Local Evaluation Plan (LEP) and a final Local Evaluation Report (LER). The purpose of the LEP is to ensure that projects funded can be evaluated and is determined at the beginning of the project. The LER is created after project completion to determine whether the overall project was effective in meeting the goals listed in the LEP. In a process evaluation, both qualitative and quantitative research methodologies will be employed as part of a data triangulation strategy, while quantitative data analysis with statistical models will be emphasized in outcome evaluations to assess the impact of each program component. ENVIRONMENTAL FINDINGS This is not a “project” for the purposes of CEQA, pursuant to CEQA Guidelines Section 15378. LOCAL PREFERENCE Local preference was not considered because accepting grant funds does not include a bid or award of a construction or service contract. FISCAL IMPACT There will be no net impact to the general fund until after June 30, 2031, when the grant project period expires. The grant provides full cost recovery for all operations, training, equipment and supplies for this program during the period of the grant. There is no match. Expenses will be claimed and reimbursed on a quarterly basis. This funding will enable the Fresno Police Department to enhance its current capabilities and response to the impacts of the legalization of cannabis within the City of Fresno.
