REPORT TO THE CITY COUNCIL June 16, 2016 FROM: Bruce Rudd, City Manager Renena Smith, Assistant City Manager SUBJECT ..Title Approve the City of Fresno Transparency in City Government Act - Article VIII Annual Compensation Disclosure Report for 2015 ..Body RECOMMENDATION City Council approve the City of Fresno Transparency in City Government Act - Article VIII Annual Compensation Disclosure Report for 2015 as reviewed and approved by the City Attorney EXECUTIVE SUMMARY The City of Fresno Transparency in City Government Act was amended on November 12, 2015. Article VIII Annual Compensation Disclosure Report specifies that the City Manager provides a written report and makes a presentation to the City Council members regarding information required in Articles III, IV, V, VI and VII. Detailed information for all sections noted is available on the City's web-site at: http://www.fresno.gov/Government/DepartmentDirectory/Personnel/Compensation.htm The City Attorney's Office has reviewed and approved to be in compliance with the Transparency Act. BACKGROUND The City of Fresno Transparency in City Government Act was amended on November 12, 2015 with the following objectives: 1. To provide annual disclosure of City of Fresno employees and elected official compensation. 2. To provide a comparative analysis of compensation levels for executive employees and elected officials in peer cities in California. 3. Adopt enabling legislation via a municipal resolution to establish necessary policy. Article VIII Annual Compensation Disclosure Report specifies that the City Manager provides a written report and makes a presentation to the City Council members regarding information required in Articles III, IV, V, VI and VII. Detailed information for all sections noted is available on the City's web-site at: http://www.fresno.gov/Government/DepartmentDirectory/Personnel/Compensation.htm The reports provide annual compensation information for the period January 1 - December 31, 2015. Article III notes that cash bonuses and deferred compensation are prohibited as of November 12, 2015. The reports note payments that were paid prior to the change in policy. Employee contracts for January - December 2016 exclude these benefits. Article III -City Elected Officials and Employee Earnings Disclosure provides gross wages as reported on the year end W-2 form as well as itemized categories required by the Act. The calendar year 2015 contained 27 pay periods rather than 26 which is the basis of base salary. For this reason the W-2 reported wages is higher for employees than the base salary per the Salary Resolution or labor contracts. Article IV Consultant Disclosure for January 1 - December 31, 2015 is also located on the City of Fresno web-site at: http://www.fresno.gov/Government/DepartmentDirectory/Personnel/Compensation.htm Article V Employment Contracts effective on December 31, 2015 have been provided to the City Clerk and can be reviewed at: http://www.fresno.gov/Government/CityClerk/execcontract.htm. Furthermore, employment contracts have been amended to come into compliance with the City of Fresno Transparency in City Government Act as amended on November 12, 2015. These have also been provided to the City Clerk to post on the web-site. It should be noted that in preparation of this report that it was discovered that there is language contained in the adopted Fiscal Year 2016 Salary Resolution that is in conflict with the recent amendments to the Transparency Act related to deferred compensation. The Fiscal Year 2017 Salary Resolution, which will be presented to Council on June 23, 2016, will be amended to address these issues ENVIRONMENTAL FINDINGS N/A LOCAL PREFERENCE N/A FISCAL IMPACT Report of Annual Compensation does not impact budget or funding.
