EXECUTIVE SUMMARY On June 15, 2017, the Council adopted Resolution No. 2017-159, establishing procedures for the approval of certain amendments to contracts. While the resolution was intended to address materials, supplies and service agreements, the resolution as adopted would technically include professional consulting services as well, which was not the intent of the June 2017 agenda item. Staff therefore recommends that the Council adopts this new resolution clearly stating that this resolution does not apply to professional consulting service agreements. With adoption of the new resolution, the delegated authority will be properly restored to provide $50,000 of authority to the City Manager, with Council approval required for any consulting agreements over $50,000 or amendments to agreements which bring the total over $50,000. BACKGROUND The City Council adopted Resolution No. 2017-159 on June 15, 2017, establishing procedures for the approval of certain amendments to contracts. The resolution established multiple approval thresholds, consistent with requirement contracts and construction contracts, at different dollar amounts for amendments to agreements for purchasing materials, supplies, equipment, or services. The intent was to provide the relevant Department Director or City Manager delegation to approve minor amendments on large contracts that are time sensitive. However, the current resolution allows for the approval threshold to be applied to professional consultant service agreements, and thus creates a conflict with the already established contracting requirements in Section 4-107 of the Fresno Municipal Code. This resolution was never intended to change the approval thresholds already in place for those agreements; therefore staff is recommending the revision to specifically exclude professional consultant service agreements. The delegated authority for the City Manager or designee to approve professional consultant service agreements with a total up to or equal to $50,000, per Section 4-107 of the Fresno Municipal Code, remains in effect. ENVIRONMENTAL FINDINGS Adoption of this resolution is not a project as defined by the California Environmental Quality Act. LOCAL PREFERENCE Local preference is not applicable for adoption of this resolution. FISCAL IMPACT There will be no fiscal impact associated with the recommended action. Attachment: Resolution
