Inc., of Clovis, California for the South Marks Avenue Temporary Storm Drain Basin Construction, Street Improvements and Veterans Home Basin Backfill project, Bid File 3611(Council District 3) ..Body RECOMMENDATION Staff recommends that the City Council award a construction contract with Jim Crawford Construction Co. Inc., of Clovis, California in the amount of $328,722 as the lowest responsive and responsible bidder for the South Marks Avenue Temporary Storm Drain Basin Construction, Street Improvements, and Veterans Home Basin Backfill project and authorize the Public Works Director or designee to sign the standardized contract on behalf of the City of Fresno. EXECUTIVE SUMMARY The City of Fresno seeks to construct a new temporary storm drain basin, new storm drain pipeline, and back fill the existing California Veterans Home on-site drainage basin. The project will also construct a new curb ramp, return and minor street improvements in South Marks Avenue. The construction of the proposed improvements will satisfy the remaining conditions of the agreement between the City of Fresno and the Department of Veterans Affairs related to the construction of the California Veterans Home. BACKGROUND This South Marks Avenue Temporary Storm Drain Basin Construction, Street Improvements and Veterans Home Basin Backfill project was included in an agreement between the City of Fresno and the Department of Veterans Affairs, dated June 18, 2009. In the agreement, the City agreed to construct street and storm drain improvements in West California Avenue and South Marks Avenue and construct facilities to divert storm run-off from the Veterans Home property. The street and the majority of storm drain construction were completed in 2012, with the remainder of the work to be completed by the end of the 2018 calendar year. In the adopted 2011 budget, the Public Works Department appropriated funds to install frontage improvements including storm drain infrastructure to connect to the Veterans Home on-site storm drain system. Due to the Running Horse Development bankruptcy proceedings, the property was sold to C & A Farms, LLC., and converted to agricultural use. On September 25, 2013, the City of Fresno filed an order of condemnation with the County of Fresno for a 0.92 acre parcel immediately south of the Veterans Home facility, fronting onto South Marks Avenue. Staff prepared bid documents with a scope that included excavation of a new temporary storm drain basin, backfill of the existing Veterans Home on-site drainage basin, construction of a storm drain pipe line in South Marks Avenue and construction of street improvements in South Marks Avenue. The Notice Inviting Bids was published in the Business Journal on August 3, 2018, posted on the City's website and faxed to eleven (11) building exchanges. The specifications were distributed to eleven (11) prospective bidders. Four (4) sealed bid proposals were received and opened in a public bid opening on August 21, 2018. Bids ranged $328,722 to $739,588. Jim Crawford Construction Co. Inc. submitted a bid in the amount of $328,722 and was determined to be the lowest responsive and responsible bidder for the project. The bids will expire 64 days after the bid opening on Wednesday, October 24, 2018. Staff is recommending that the Council award a construction contract with Jim Crawford Construction Co. Inc., of Clovis in the amount of $328,722 for the South Marks Avenue Temporary Storm Drain Basin Construction, Street Improvements, and Veterans Home Basin Backfill Project, and authorize the Public Works Director or his designee to sign and execute the standardized contract on behalf of the City of Fresno. ENVIRONMENTAL FINDINGS A categorical exemption through EA-11-011 was adopted by the Council on October 20, 2011 for this Project. An analysis has been performed pursuant to CEQA Guidelines �15162 to determine whether subsequent environmental review is required for the Project. Based on this analysis the following findings are made to support the determination that no subsequent environmental review is required: 1. No substantial changes are proposed in the Project which will require major revisions of the previous Exemption due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects. 2. No substantial changes occur with respect to the circumstances under which the Project is undertaken which will require major revisions of the previous Exemption due to the involvement of new significant environmental effects, or a substantial increase in the severity of previously identified significant effects. 3. There is no new information which was not known or could not have been known at the time of the previous Exemption that the Project will have significant effects not discussed in the Exemption. Furthermore, since an categorical exemption was previously adopted for this Project, the considerations set forth in CEQA Guidelines �15162(a)(3)(C) and (D), related to the adequacy and feasibility of previously adopted mitigation measures, are not applicable. Based upon these findings, it has been determined that no further environmental documentation is required for this Project. LOCAL PREFERENCE Local preference was not implemented due to all bidders being located in the Fresno area. FISCAL IMPACT The project, which is located in Council District 3, will not have any impact to the General Fund. The overall cost of the project is $456,442 and is funded by Proposition 111 Gas Tax funds. Of the overall project cost, $328,722 will be for this construction contract award. All funds necessary for the contract award are included in this fiscal years approved City of Fresno budget.
