EXECUTIVE SUMMARY Caltrans recently completed the process of relocating a section of State Route 99, between Clinton Avenue and Ashlan Avenue to make room for the High Speed Rail Project. Previously, Caltrans identified several City utilities that were in conflict with the proposed improvements and needed to be relocated with the City streets. Newly constructed water main facilities have required City staff to perform wet tie connections to put the new facilities into service. Increased costs for these wet tie connections, over and above those estimated at the time of execution of the original agreement with Caltrans, were incurred. City and Caltrans staff have come to an agreement for Caltrans to reimburse the City for all additional wet tie connection costs for this work. BACKGROUND Caltrans recently completed relocating a section of State Route 99, between Clinton Avenue and Ashlan Avenue. The State Route 99 Relocation Project consists of reconstruction of the Clinton Avenue interchange and the Ashlan Avenue overhead structure, closure of three partial interchanges and realignment of local and frontage roads. Throughout the project development process Caltrans has identified several City utilities that are in conflict with the proposed improvements and that needed to be relocated along with the City streets. The construction has resulted in the City's existing sewer and water mains within the project limits being replaced with new infrastructure. It was previously agreed that City staff would perform all wet tie connections before the new water facilities are put into service and that Caltrans would reimburse the City for all wet tie connection costs for this work. On December 18, 2014, Council approved Caltrans Utility Agreement No. 06-1398.011 for the City to be reimbursed for design and inspection costs associated with the relocation work. The City of Fresno Design Services Section developed the utility relocation plans per City standards for Caltrans to use in construction. On December 17, 2015, Council approved Caltrans Utility Agreement No. 06-1398.15 for the City to be reimbursed in the amount of $112,500 for performing wet tie connections to the City water system that are associated with the relocation work. Increased costs for these wet tie connections, over and above those estimated at the time of execution of the agreement with Caltrans, were incurred and Caltrans wishes to pay the City for such additional cost. Caltrans has provided the attached Second Amendment to the Utility Agreement No. 06-1398.15. Staff recommends that the City Council approve an amendment to the Utility Agreement No. 06-1398.15 with Caltrans for the relocation of City water and sewer utilities associated with the State Route 99 Relocation Project, for a net increase of $165,972.41 and authorize the Public Works Director or designee to execute this amendment on behalf of the City. ENVIRONMENTAL FINDINGS The approval of this amendment is not a project as defined by the California Environmental Quality Act. LOCAL PREFERENCE Local preference was not implemented because this is not a competitive bid award. FISCAL IMPACT There will be no impact to the General Fund or any City operating funds associated with the recommended action. The City of Fresno will be reimbursed by Caltrans for all costs associated with the wet tie connections to the City's water system.
