MOZIER, P.E., Director Public Works Department BY: RANDALL MORRISON, P.E., Assistant Director Public Works Department, Engineering Division SUBJECT ..Title ***RESOLUTION - Adopting the 8th Amendment to the Annual Appropriation Resolution No. 2020-159 appropriating $68,389,900 for new capital projects in the Public Works Department (citywide) (Subject to Mayor's veto) (Requires 5 votes) ..Body RECOMMENDATIONS Staff recommends that the City Council adopt the 8th Amendment to the Annual Appropriation Resolution No. 2020-159 appropriating $68,389,900 for new capital projects in the Public Works Department. EXECUTIVE SUMMARY There are several new capital improvement projects staff is preparing to implement which are funded from State grants, Federal grants, and other local sources. The grant funded projects were awarded State funds through the Active Transportation Program (ATP) administered through the California Department of Transportation (Caltrans), State Transportation Improvement Program (STIP) funds through the California Transportation Commission (CTC), Better Utilizing Investments to Leverage Development (BUILD) Transportation Discretionary Grant funding through the U.S. Department of Transportation (USDOT), Federal transportation funds through the Congestion Mitigation and Air Quality Improvement Program (CMAQ) and Surface Transportation Block Grant Program (STBG) administered by the Fresno Council of Governments (Fresno COG). Also included are Senate Bill 1 (SB1) projects that were included in the resolution adopted by Council on June 11, 2020, but not included in the Continuing Resolution for the City budget. Staff recommends Council adopt the amendment to the AAR in order to provide appropriations in the Public Works FY2020 Capital Budget to sufficiently cover anticipated expenditures for the cost of these new projects. BACKGROUND Staff is seeking Council approval of the attached AAR amendment which will appropriate funding for 17 new capital projects. The projects are funded via a combination of State funding, Federal funding and other local funding, including developer deposits. The appropriations requested for current FY2021 expenditures total $68,389,900. The remaining project costs of $20,962,100 will be included in the proposed FY2022 capital improvement budget and generally include the construction phases of these 17 projects. Street Projects - This category consists of eight projects, with total appropriations requested for this category in the amount of $66,708,300: * The FY21 Neighborhood Streets Improvement project is funded by Prop. 111 Gas Tax and ABX8 6 Gas Tax. The project is the 7-week Concrete program which is located Citywide. * Cedar Avenue Overlay from Jensen Avenue to Hamilton Avenue and Blackstone Avenue Overlay from Minarets Avenue to Nees Avenue includes asphalt overlay, installation of curb ramps, signal loop detectors, signage, and striping. These projects were previously authorized by Council as part of Resolution 2019-193 for grant applications to Fresno COG. * Veterans Boulevard from Riverside Drive to Herndon Avenue Connection was previously authorized by Council as part of Resolution 2020-127 for a grant application to CTC and the Fresno County Transportation Authority. Veterans Boulevard SR99 Interchange and Grade Separation was previously authorized by Council as part of Resolution 2019-117 for a grant application to the USDOT. * The Blackstone Avenue and McKinley Avenue Lingo project and the Blackstone Avenue and McKinley Avenue Grade Separation projects were previously authorized by Council through Cooperative agreements with the Fresno County Transportation Authority. Street Lighting Projects - This category consists of one project for streetlight installation. The project is located on Shaw Avenue from Cedar to Chestnut Avenues. This project was previously authorized by Council as part of Resolution 2019-193 for grant applications to Fresno COG. Total appropriations for this category are $71,200 for the preliminary engineering phase of the project. Traffic Signal Projects - This category consists of two projects to install new Traffic Signals and one Intelligent Traffic Synchronization (ITS) Project, with total appropriations requested for this category in the amount of $824,500: * Funding for the Traffic Signal projects is through SB1 Road Repair Gas Tax. Locations include Hughes Avenue and Shields Avenue Left Turn Phasing, and Blythe Avenue and Gates Avenue, in accordance with the SB1 resolution adopted on June 11, 2020 for FY2021 Public Works projects. * The ITS project is located on Jensen Avenue and is funded through a grant from the Federal CMAQ program, to deliver traffic synchronization benefits to the Jensen corridor similar to other arterials in the City. Bicycle and Trail Projects - This category includes one project, the Master Trails and Bike Plan. Total appropriations requested for this category are $35,000. Miscellaneous Projects - This category includes appropriations for three Right-of-Way Acquisition projects and the High Speed Rail Development Services project, with total appropriations for these projects in the amount of $750,900: * The Right-of-Way projects are for Tracts 6210, 6214 and 6215. All right-of-way acquisitions have been paid by the developers through the subdivision agreements for each project. * The High Speed Rail Development Services project will cover the contract extension with TPZP which was approved by Council on June 19, 2019. ENVIRONMENTAL FINDINGS This approval is not a project as defined by Section 15378 of the California Environmental Quality Act Guidelines. LOCAL PREFERENCE Local preference does not apply because approval of the 8th Amendment to the AAR does not include a bid or award of a construction or service contract. Local preference (if applicable) will be considered at the time of contract award for the identified projects. FISCAL IMPACT There is no new net fiscal impact to the General Fund. All proposed costs will be paid for from new and existing revenue sources. See attached Resolution for specific funds and associated costs.
