REPORT TO THE CITY COUNCIL August 27, 2020 FROM: SCOTT L. MOZIER, P.E., Director Public Works Department BY: WILLIAM HERR, Assistant Director Public Works Department, Facilities and Construction Management Divisions SUBJECT ..Title ***RESOLUTION - Adopting the 15th Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $18,454,300 for the Animal Shelter Project in the Public Works Department (Subject to Mayor's veto) (Requires 5 votes) ..Body RECOMMENDATIONS Staff recommends that the City Council adopt the 15th Amendment to the Annual Appropriation Resolution No. 2020-159 to appropriate $18,454,300 for the Animal Shelter Project in the Public Works Department. EXECUTIVE SUMMARY Staff recommends the Council adopt a resolution approving the re-budget of appropriations for the previously approved Animal Shelter project, originally approved by Council as part of the 44th Amendment to the Annual Appropriations Resolution No. 2019-133. The recommended resolution will appropriate $18,454,300 in carryover funding from FY 2020 to the current fiscal budget year and appropriate the FY 2021 funding in order to provide appropriations to cover expenditures for the Animal Shelter project as previously approved by the Council. BACKGROUND On May 21, 2020, the Council awarded a construction contract in the amount of $14,500,000 for the construction of the Animal Control Facility, approved the 44th Amendment to the Annual Appropriations Resolution No. 2019-133, and approved an Inter-fund Loan Agreement from the Water Enterprise fund. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a project as defined by the California Environmental Quality Act. LOCAL PREFERENCE Local preference does not apply to the projects included in this report as this is a re-budget item only. However the construction contract previously awarded by the Council was to a local construction company. FISCAL IMPACT All project costs will be paid for by appropriations from the Animal Control Facility fund. The reimbursement resolution will allow for these expenditures to be financed through bond proceeds. Ongoing operational expenses for the facility will be included in City budgets for FY 2022 and beyond, in a similar manner as the historical budgetary approach with the CCSPCA contractual expenses. Attachment: 15th Amendment to the Annual Appropriation Resolution No. 2020-159
