Keller - James H. Wegley Consulting Engineers, to extend the Agreement from December 31, 2019, to May 31, 2020, for the Upper San Joaquin River and Friant Kern Canal 5-Year Sanitary Survey Update, with no change to the previously authorized contract amount of $55,385 (Citywide) ..Body RECOMMENDATIONS Staff recommends that City Council approve a Second Amendment to the Consultant Services Agreement with Dennis R. Keller - James H. Wegley Consulting Engineers (Keller/Wegley), to extend the Agreement to May 31, 2020, for the Upper San Joaquin River and Friant Kern Canal 5-Year Sanitary Survey Update (Project) as required by the State Water Resources Control Board (SWRCB) and authorize the Director of Public Utilities, or designee, to sign the Amendment on behalf of the City of Fresno (City). EXECUTIVE SUMMARY The City utilizes surface waters from the Upper San Joaquin River and Friant Kern Canal in the treatment and production of potable water at its 30 million gallon per day Northeast Surface Water Treatment Facility (NESWTF). For the continued operation and permitting of the NESWTF, the SWRCB requires Sanitary Survey Updates be performed every five years which identify and monitor potential impacts to water quality from these sources. Keller/Wegley is uniquely qualified to perform these services through their long-term efforts related to generation of the original 1998 Sanitary Survey for the City. Their intimate knowledge of SWRCB requirements have resulted in delivery and acceptance of previous 5-year updates in 2002, 2008, and 2013. This Second Amendment will extend the Consultant Services Agreement to May 31, 2020, to allow for SWRCB review. BACKGROUND In compliance with SWRCB requirements, watershed sanitary surveys must be conducted to identify conditions that may affect water quality when surface waters are to be utilized for the treatment and production of potable water. The SWRCB also requires that potential changes to watershed conditions be verified every five years through submission of 5-Year Sanitary Survey Updates. In 1998, through a cooperative Memorandum of Understanding with ten other participating cities and districts, Keller/Wegley prepared and submitted the initial sanitary survey of the Upper San Joaquin River Watershed and Friant Kern Canal. The Sanitary Survey addresses watershed conditions and the specific needs of the City and each participating entity. With this unique and intimate knowledge, Keller/Wegley has provided the City and other participating entities the subsequent 5-year sanitary surveys updates in 2002, 2008, and 2013 to satisfying SWRCB requirements. On April 5, 2018, the City entered into a Consulting Services Agreement with Keller/Wegley Engineers in the amount of $55,385 for the Upper San Joaquin River and Friant Kern Canal 5-Year Sanitary Survey Update as required by the State Water Resources Control Board. The First Amendment extended the Consultant Services Agreement to December 31, 2019, to complete the Project. Due to personnel changes within the SWRCB, this Second Amendment will extend the Consultant Services Agreement to May 31, 2020, to allow for SWRCB review of submitted draft documents. No additional compensation is being negotiated. Attorney's Office has reviewed and approved as to form this Second Amendment to the Agreement. Upon approval by the City Council, the Second Amendment to Agreement will be executed by the Director of Public Utilities, or his designee. ENVIRONMENTAL FINDINGS Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5), this is not a "project" for the purpose of CEQA, as this is an organizational or administrative action of the government to enforce an existing obligation, and will not result in a direct or indirect physical change in the environment. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing consultant services agreement. FISCAL IMPACT There is no impact to the General Fund. This Project is located Citywide. Appropriations for these sanitary survey updates were encumbered in the Water Operating Division budget and will fund these expenditures.
