2. Approve the Third Amendment to the Consultant Services Agreement with Carollo Engineers Inc. of Fresno, California, in the amount of $427,370, increasing the total contract amount to $3,164,649, with a remaining contingency of $374,000, to expand the scope of services to include construction support for the Downtown Redevelopment Grant Water and Sewer Improvements Project.

RECOMMENDATIONS
Staff recommends City Council (1) adopt the 6th Amendment to the Annual Appropriation Resolution No. 2024-122 appropriating $3,495,800 for the Downtown Redevelopment Grant Water and Sewer Improvements Project (Project), (2) approve the Third Amendment to the Consultant Services Agreement with Carollo Engineers Inc., of Fresno, California, in the amount of $427,370, increasing the total contract amount to $3,164,649, with a remaining contingency of $374,000 to expand the scope of services to include construction support for the Downtown Redevelopment Grant Water and Sewer Improvements Project, and authorize the Capital Projects Director or designee to sign and execute the Third Amendment on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
On June 13, 2024, Council awarded a water main and sewer main replacement construction contract to Floyd Johnston Construction Co. Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $18,784,925.50 for the Base Bid plus all three (3) add alternates for the Project. The City now seeks to adopt the 6th Amendment to the Annual Appropriation Resolution No. 2024-122 appropriating $3,495,800 for construction contingency, construction management by City staff, and construction support services by the design consultant, Carollo Engineers, Inc. Funding for this Project is provided by dollars received by the State of California for the Downtown Public Infrastructure Improvements Projects. Approval of the 6th Amendment to the Annual Appropriation Resolution will appropriate $3,495,800 to fully fund construction contingency, construction management by City staff, and construction support services by the design consultant.
BACKGROUND
The downtown area has some of the oldest water and wastewater infrastructure in the City, which has reached the end of its service life. Recognizing the uniqueness of zero lot line construction in the downtown area, the Department of Public Utilities entered into a Consultant Services Agreement with Carollo Engineers, Inc. dated May 31, 2023, in the amount of $736,873, with a contingency amount of $74,000, to conduct a study to evaluate relocation options for water and wastewater infrastructure in the downtown area. Inclusive of this evaluation is the review of system capacities to ensure the renewal infrastructure meets current design standards. The resulting documents will guide design and phasing of renewal capital improvement projects, as well as assist in establishing conditions of approval for infrastructure improvements needed for future development projects. Since the award of this contract, the City received dollars by the State of California for the Downtown Public Infrastructure Improvements Project in the amount of $50 million. Roughly $24 million has been allocated for water and wastewater improvements in the downtown area bounded by Van Ness Avenue, Ventura Street, E Street and Tuolumne Street.
The First Amendment to the original Consultant Services Agreement, dated November 27, 2023, in the amount of $2,000,406, with an additional contingency amount of $300,000, increased the total contract amount to $2,737,279 and a remaining contingency of $374,000 to expedite professional design efforts and award the construction project within Fiscal Year 2024. A construction contract was subsequently awarded to Floyd Johnston Construction Co. Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $18,784,925.50 for the Base Bid plus all three (3) add alternates for the Project.
The Second Amendment to the original Consultant Services Agreement, dated April 17, 2024, was approved to recognize the new labor rates in the Carollo Engineers, Inc. 2024 Fee Schedule.
Staff now recommends City Council adopt the 6th Amendment to the Annual Appropriation Resolution No. 2024-122 appropriating $3,495,800 for to fully fund construction contingency, construction management by City staff, and construction support services by the design consultant, approve the Third Amendment to the Consultant Services Agreement with Carollo Engineers Inc., of Fresno, California, in the amount of $427,370, increasing the total contract amount to $3,164,649, with a remaining contingency of $374,000 to expand the scope of services to include construction support for the Downtown Redevelopment Grant Water and Sewer Improvements Project, and authorize the Capital Projects Director or designee to sign and execute the Third Amendment on behalf of the City.
The City Attorney's Office has reviewed and approved the proposed amendment as to form.
ENVIRONMENTAL FINDINGS
Contract amendment does not qualify as a project pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15378.
LOCAL PREFERENCE
Carollo Engineers, Inc. is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
There is no impact to the General Fund. This Project is located in Council District 3. Funding for this Project was provided by dollars received by the State of California for the Downtown Public Infrastructure Improvements Project. Adoption of the attached 6th Amendment to the Annual Appropriation Resolution No. 2024-122 will fully fund construction contingency, construction management by City staff, and construction support services by the design consultant.
