EXECUTIVE SUMMARY
The City of Fresno Mobilehome Park Rent Review and Stabilization (MPRRS) Ordinance provides that mobilehome park owners are only to submit their yearly application for a rent increase on the forms prescribed by the Director (in this instance, the City Attorney or their delegate). (Fresno Municipal Code (FMC) Sections 1-302(c), 12-2003(f), and 12-2009(b).) As the Commission is charged with hearing, reviewing, and making determinations on rent increase applications, it is important that the forms aggregate information in a way that assists the Commission in making informed decisions.
Upon review of the current Rent Increase Application Packet (Packet) issued to park owners during the March 12, 2024, MPRRS Commission meeting, Commissioners requested a new form be created, and the full Packet be digitized. Staff is presenting the revised Packet with those changes, and additional changes to improve clarity, for Commissioner review and feedback.
BACKGROUND
New Form: MRR 1-4
Commissioners requested a new form be created, to act as a cover letter for non-automatic rent increases under FMC section 12-2012. Each document submitted in support of a park owner's proposed increase would need to be listed with (1) the document's title; (2) which "fair, just, and reasonable" factor the documents is attributed to; (3) the page numbers of the document within the packet; and (4) a short summary of why the document is relevant to that factor.
Staff has drafted "Form MRR 1-4 - Cover Sheet for Supporting Documents" to meet this need. Of note, park owners will be able to fill out as many copies of the second page as needed, depending on the number of supporting documents they are submitting, similar to how Form MRR 1-3 is currently arranged.
Digitization: Forms MRR 1-1 and 4-1
Last year's Packet (sent out November 2023 for use during the 2024 year) did include a place for park owners and park residents' committee chairs to submit their email addresses (See Forms MRR 1-1 and 4-1). To maximize digitization, the City will send an electronic copy of the Packet to those who already provided their email addresses on the completed forms. Additionally, a note was added to Forms MRR 1-1 and 4-1 providing notice that electronic copies of the packet were available by contacting Code Enforcement.
Digitization: Fillable Form
To ensure those who wish to go fully paperless are able to do so, the electronic copy of the Packet will be a fillable .pdf. Park owners and park residents' committee chairs will be able to complete the forms without the need for any printing.
Additional Clarity: Form MRR 2-2 Revised
The current Packet did not explicitly address what information was needed in the event that a park owner claimed to be seeking only the automatic CPI increase authorized under FMC � 12-2014, but the park residents' committee believed the calculations were incorrect, resulting in an amount in excess of what would be automatically permitted.
Staff drafted a revision to "Form MRR 2-2 - Automatic CPI Rent Increase Request" to address this issue. Park residents' committees can now explicitly notify the park owner and the City that they find the claimed amount is miscalculated and exceeds what is permitted automatically. It also contains a directive for the residents' committee to explain their reasoning, and proceed with treating the excess amount as a Non-Automatic Rent Increase request.
