CAMIT, PLS, Chief Surveyor Public Works Department, Engineering Services, Right of Way Section SUBJECT ..Title HEARING to consider the vacation of a portion of public street right of way at the northeast corner of South Hughes Avenue and West Dan Ronquillo Drive (District 3): 1. ***RESOLUTION - Ordering the vacation a portion of public street right of way at the northeast corner of South Hughes Avenue and West Dan Ronquillo Drive (Subject to Mayor's Veto) ..Body RECOMMENDATION Staff recommends the City Council to conduct the required public hearing and at the close of the hearing, adopt the attached resolution ordering vacation of a portion of public street right of way at the northeast corner of South Hughes Avenue and West Dan Ronquillo Drive. EXECUTIVE SUMMARY Harjit Singh Swatch and Prabjit Singh of GS Central Valley Investments, LLC are proposing to vacate a portion of public street right of way at the northeast corner of South Hughes Avenue and West Dan Ronquillo Drive. The purpose of this vacation is disposed of excess right of way and accommodate Site Plan Number P21-06225, which is the proposed construction of a truck wash, lube, and repair development. BACKGROUND This portion of South Hughes Avenue and West Dan Ronquillo Drive was originally dedicated for a cul-de-sac to accommodate the construction of State Route 180, which resulted in a dead-end street at this area of South Hughes Avenue. In 2014, West Dan Ronquillo Drive was constructed, connecting South Hughes Avenue to the Hughes-West Diagonal. This new traffic circulation rendered the cul-de-sac unnecessary and the associated street improvements were removed. This creates excess right of way to be disposed of in this area. This vacation will also accommodate Site Plan Number P21-06225, which is the proposed construction of a truck wash, lube, and repair development. The Public Works Department, other City departments and utility agencies have reviewed the proposed vacation and determined that the public street easement proposed for vacation is unnecessary for present or prospective public street purposes, as described in Exhibit "A" and as shown on Exhibit "B", subject to conditions of approval as listed in Exhibit C", said exhibits are included in the attached Resolution to Vacate. The City will be disposing of this portion of land in accordance with the Surplus Land Act. City Attorney's Office has approved the attached Resolution to Vacate as to form. The vacation, if approved by the Council at the public hearing, will become effective when the vacating resolution is recorded in the office of the Fresno County Recorder, but not until the City Engineer determines that the conditions listed in the attached resolution have been satisfied and accepted by the City. ENVIRONMENTAL FINDINGS Environmental Assessment Number P21-06225, was adopted by Council on October 31, 2024 and is Categorically Exempt pursuant to Section 15332/Class 32 of the California Environmental Quality Act (CEQA) Guidelines. LOCAL PREFERENCE Local preference does not apply because the vacation of a public street easement does not involve bidding or contracting. FISCAL IMPACT This vacation is located in Council District 3 and there will be no City funds involved with this project.
