REPORT TO THE CITY COUNCIL FROM: SUMEET MALHI, Director Personnel Services Department BY: JENNIFER MISNER, Assistant Director Personnel Services Department SUBJECT ..Title Approve a Side Letter of Agreement with the Fresno Police Officers Association (FPOA), for Unit 4 - Non-Management Police, regarding Assignment of Overtime Shifts (Subject to Mayor's Veto) ..Body RECOMMENDATION It is recommended Council approve a Side Letter of Agreement with FPOA, Unit 4, regarding Assignment of Overtime Shifts. EXECUTIVE SUMMARY A Side Letter of Agreement with FPOA would further define the assignment of overtime shifts within the Fresno Police Department to include voluntary overtime scheduling, mandatory overtime (MOT) scheduling and addressing the Call Off of an Officer who was previously assigned an overtime shift. Officers called off when previously scheduled for overtime would be compensated for one (1) hour of pay at time and one half (1/2). The City of Fresno ("City") and the Fresno Police Officers Association ("Association"), representing Unit 4, Non-Supervisory Police, have met and conferred and agreed to this Side Letter of Agreement ("Agreement"). BACKGROUND The Fresno Police Department experiences staffing shortages. In order to cover staffing shortage, Officers may volunteer for overtime and any remaining uncovered shifts will be assigned as MOT. Department Policy 216 (Staffing Levels) currently addresses staffing levels, and this proposed Side Letter Agreement further defines the administration of MOT. MOT will be assigned on reverse seniority; officers will be provided a five (5) calendar day notice and will receive credit for the MOT shift served. Officers may use Absent with Substitute (AWS) to replace their assigned shift. Should an Officer be scheduled for MOT and is no longer required, up to 90 minutes prior to the MOT shift starting the Officer may be called off. To compensate for arranging their day off the Officer will receive one (1) hour of pay at time and one half (1/2) their hourly rate of pay. The City Attorney's Office has approved the Side Letter of Agreement as to form. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a "project" and is therefore exempt from the California Environmental Quality Act requirements. LOCAL PREFERENCE Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno. FISCAL IMPACT Approval of the Side Letter of Agreement is projected to cost $6,350 for the remainder of the fiscal year.
