CAMARENA, Chief Assistant City Attorney SUBJECT ..Title ***RESOLUTION - Authorizing the submission of applications for CalRecycle grant program funds, including up to $350,000 annually for Waste Tire Enforcement, up to $100,000 per two-year grant term for Waste Tire Cleanup, and up to $40,000 per two-year grant term for Waste Tire Amnesty, and acceptance of funding in amounts to be determined by CalRecycle, and authorizing the City Attorney and/or designee to sign all necessary implementing documents (Subject to Mayor's Veto). ..Body RECOMMENDATION Staff recommends Council adopt the attached resolution authorizing the City Attorney's Office to apply for and accept grant program funds through the California Department of Resources Recycling and Recovery (CalRecycle) Local Government Waste Tire Enforcement, Waste Tire Cleanup, and Waste Tire Amnesty grant programs. EXECUTIVE SUMMARY Grant funding is available through the State of California for local enforcement efforts to reduce, recycle, and reuse waste tires. The City Attorney's Office desires to apply for such grant funding. BACKGROUND The CalRecycle Waste Tire Enforcement Grant allows the City of Fresno to apply for up to $350,000 annually to cover the cost of staffing and equipment necessary to continue the Waste Tire Enforcement Program which monitors and regulates tire facilities within City limits. These grant funds are also used to investigate illegal dumping involving waste tires. The CalRecycle Waste Tire Cleanup Grant allows the City of Fresno to apply for up to $100,000 per two-year grant term to cover the cost of staffing and equipment necessary to continue the Waste Tire Cleanup Program which collects illegally dumped waste tires throughout the City. All waste tires collected are recycled through CalRecycle. The CalRecycle Waste Tire Amnesty Grant allows the City of Fresno to apply for up to $40,000 per two-year grant term to cover the cost of staffing and equipment necessary to continue the Waste Tire Amnesty Program which holds three annual events for City residents to properly dispose of waste tires. All waste tires collected are recycled through CalRecycle. CalRecycle grants require entities submitting applications to provide a resolution approved by their governing body authorizing submission of the application and identifying signature authorities. This Council previously adopted a similar resolution (Resolution 2019-180) that is set to expire on September 19, 2024, thus necessitating a new resolution in order to continue application for and acceptance of CalRecycle grant program funds. ENVIRONMENTAL FINDINGS The resolution is not a project as defined by California Environmental Quality Act Guidelines Section 15378. LOCAL PREFERENCE Local preference is not applicable because this resolution does not include a bid or award of a construction or services contract. FISCAL IMPACT There will be minimal impact to the City Attorney's Office for staff time to prepare and submit the applications. If Fresno is awarded grant funds, the amount of those funds will be used to continue existing enforcement programs without impacting the General Fund or City Attorney's Office budget. Under the terms of each grant, approved expenditures are reimbursed to the City up to the maximum amount of award. The CalRecycle grant programs do not require the City to match funds.
