Parks Community Center: 1. Approve a Second Amendment for Consultant Services with Kleinfelder, Inc. for Environmental Engineering Services in the amount not to exceed of $85,200 to provide additional services for Maxie L. Parks site located at 2165 South Elm Street, Fresno, CA 93706. 2. Authorize City Manager or designee to execute the agreement on behalf of the City of Fresno. ..Body RECOMMENDATION Staff recommends that the City Council approve a second amendment for Consultant Services with Kleinfelder in the amount not to exceed $85,200, to provide additional environmental engineering services and authorize the City Manager or designee to sign all related documents on behalf of the City. EXECUTIVE SUMMARY On April 9, 2024, the City of Fresno submitted the results of an additional on-site assessment as requested by the Regional Water Quality Control Board related to the Former Imperial Laundry site. The City is requesting Kleinfelder revise the Feasibility Study and provide project management and document preparation and support to move the site to regulatory closure. BACKGROUND On October 20, 2023, the City of Fresno entered into a consultant agreement with Kleinfelder, Inc. for an additional assessment of the Maxie L. Parks site based on the Central Valley Regional Water Quality Control Board's (RWQCB) recommendations. The additional assessment involved installing permanent vapor monitoring points and conducting soil testing. On November 9, 2023, on-site vapor monitoring was completed. On November 10, 2023, Kleinfelder contacted the City to communicate that while two of the nine vapor monitoring points were sampled, seven other vapor monitoring points were unable to be sampled as they were no longer available and/or viable. Based on this information, the City met with the RWQCB to discuss the most appropriate means to collect the information requested. On January 11, 2024, PARCS executed a first amendment to continue and complete the additional services. On January 30, 2024, Kleinfelder and their subcontractor Confluence Technical Service conducted a soil vapor probe installation at the site as approved by the RWQCB on January 18, 2024. The installation was comprised of the triple-nested vapor monitoring probes. On February 15, 2024, Confluence Environmental Services conducted soil vapor sampling and were analyzed by USEPA Modified Method O-15-ll by ASTM Method D1946 by Eurofins Air Toxics Laboratory. On April 3, 2024, the City received the results of the additional on-site assessment of constituents of concern. The results showed that concentrations of benzene measured were below the residential environmental screening limits (ESL) in both soil and vapor samples. Based on the testing findings, historical analysis, and analysis of groundwater gradient, the consultant concluded that benzene in soil vapor did not originate at the Former Imperial Laundry site. Based on the results outlined in the assessment, the City requested Kleinfelder to prepare a proposal to revise the Feasibility Study and provide project management and document preparation to support the site for regulatory closure. The second amendment includes regulatory negotiations and research, revisions to the feasibility study, a remedial action work plan preparation and implementation for an amount not to exceed $85,200. ENVIRONMENTAL FINDINGS In accordance with California Environmental Quality Act (CEQA) Guidelines Section 15378, site assessment for the purpose of evaluating environmental conditions does not qualify as a "project" for the purposes of CEQA. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing contract. FISCAL IMPACT Funding for this project is included in the City's Adopted Fiscal Year 2025 budget from Measure P Expenditure Category 1. Attachment: Second Amendment Original Agreement
