(Council District 7) ..Body RECOMMENDATION Staff recommends that City Council approve the Second Amendment to the Consultant Services Agreement (Agreement) with AECOM Technical Services, Inc. (Consultant) of Fresno, California, to increase the total contract by an amount not to exceed $32,463 paid on a time and materials basis, for a revised total contract amount not to exceed $265,663, with a remaining contingency amount not to exceed $20,000, and extend the term of the Agreement to December 31, 2028, for additional design services related to the Wellhead Treatment Improvements at Pump Station 101A Project (Project); and authorize the Capital Projects Director or designee to sign and execute all documents on behalf of the City of Fresno (City). EXECUTIVE SUMMARY On June 10, 2022, the Department of Public Utilities (DPU) entered into a Consultant Services Agreement with AECOM Technical Services, Inc. of Fresno, California, in the amount of $233,200 with a contingency amount not to exceed $20,000 to provide engineering design services for the Project. On December 31, 2024, the City and the Consultant entered into the First Amendment to the Agreement, to extend the term of the Agreement to December 31, 2026, at no additional cost. Additional engineering services have since become necessary to revise the final plans by updating piping and instrumentation requirements and revise the procurement of the wellhead treatment facilities from an owner furnished, contractor installed approach to a contractor furnished and installed approach. Staff now recommends approval of the Second Amendment to the Agreement to increase the total contract by an amount not to exceed $32,463, for a revised total contract amount not to exceed $265,663 paid on a time and materials basis, with a remaining contingency amount not to exceed $20,000; and extend the term of the Agreement to December 31, 2028. The Second Amendment to the Agreement will be funded utilizing appropriations from the Water Enterprise Fund adopted in the Fiscal Year 2026 budget. BACKGROUND The City maintains a water supply network consisting of approximately 1,900 miles of water distribution pipelines, more than 270 municipal groundwater wells, and three surface water treatment facilities. There are currently approximately 30 well sites with wellhead treatment systems that treat regulated contaminants or naturally occurring compounds that affect taste or impart odor. On June 10, 2022, DPU entered into a Consultant Services Agreement with AECOM Technical Services, Inc. of Fresno, California, in an amount not to exceed $233,200 with a contingency amount not to exceed $20,000 paid on a time and materials basis, to provide engineering design services to install wellhead treatment facilities at Pump Station 101A. Due to a procurement requirement, the City and Consultant entered into the First Amendment to the Agreement on December 31, 2024, to extend the term of the Agreement to December 31, 2026, at no additional cost. To date, the Consultant has prepared final construction plans and specifications for wellhead treatment at Pump Station 101A. However, several changes to the proposed process piping and instrumentation components have been identified, including pressure switches and alarms, backwash pit, piping configuration, disinfection equipment, and facility upgrades. Additionally, the City proposes to revise procurement of the wellhead treatment facilities from an owner furnished, contractor installed approach to a contractor furnished and installed approach. Therefore, additional engineering services have become necessary to revise the instrumentation plans, details, and specifications, and prepare new plan sheets and technical specifications for the wellhead treatment vessels. Staff now recommends approval of the Second Amendment to the Agreement in an amount not to exceed $32,463, paid on a time and materials basis, increasing the total contract to an amount not to exceed $265,663 with a remaining contingency amount not to exceed $20,000 paid on a time and materials basis; and authorization of the Capital Projects Director or designee to sign the Second Amendment on behalf of the City. The amended scope of work includes additional engineering services necessary to revise the final plans to incorporate changes to the proposed process piping and instrumentation components and revise the approach for procuring the proposed treatment facilities. Additionally, the Second Amendment will extend the term of the Agreement from December 31, 2026, to December 31, 2028. The Second Amendment to the Agreement will be funded utilizing appropriations from the Water Enterprise Fund adopted in the Fiscal Year 2026 budget. The City Attorney's Office has reviewed and approved the Second Amendment to the Consultant Services Agreement as to form. ENVIRONMENTAL FINDINGS By the definition of the California Environmental Quality Act (CEQA) Guidelines Section 15378, the amendment of this consultant services agreement for the design services does not quality as a "project" for the purpose of CEQA. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing consultant services agreement. FISCAL IMPACT The Wellhead Treatment Improvements Project at Pump Station 101A is located in Council District 7 and will have no impact to the General Fund. The Project will be funded utilizing appropriations from the Fiscal Year 2026 Water Enterprise Fund.
