(Council District 3) ..Body RECOMMENDATION Staff recommends that Council adopt a resolution dedicating a portion of City-owned property for public utility purposes to accommodate the construction of underground utilities within Roeding Park adjacent to State Route 99. EXECUTIVE SUMMARY Caltrans has secured funding to rehabilitate and improve State Route 99 from El Dorado Street to Clinton Avenue. The project will reconstruct the freeway pavement and several bridges but will also improve freeway operations by adding auxiliary lanes. The project includes re-construction of the freeway interchange at Olive Avenue, removal of the existing entrance and exit ramps at Belmont Avenue and at McKinley Avenue, and removal of the Teilman Avenue overcrossing. To facilitate the re-construction of the interchange at Olive Avenue, existing utilities need to be relocated from the existing Olive Avenue interchange. To accommodate this utility relocation, a public utility easement (PUE) is needed under the existing Pacific, Gas, & Electric (PG&E) power pole line within City-owned Roeding Park property (Property). The dedication of the PUE will enable the City to have the authority to permit California Public Utility Commission (CPUC) registered utilities the right from time to time to excavate for, construct, reconstruct, remove, replace (of initial or any other size), maintain, inspect, and use facilities and associated equipment within the PUE area. BACKGROUND The State Route 99 Rehabilitation Project will replace much of the existing asphalt and concrete travel lanes from El Dorado Street to Clinton Avenue on the north. The project includes replacing several existing bridges and building retaining walls to provide space for a future additional lane in each direction. A new interchange will be constructed at Olive Avenue with roundabouts on each side of the freeway to connect to the entrance and exit ramps. The existing southbound entrance ramp and northbound exit ramp at McKinley Avenue will be removed. The entrance and exit ramps at Belmont Avenue will also be removed and not replaced. The Teilman Avenue overcrossing will be removed. New cul-de-sacs will be constructed on each side of the freeway where Teilman will end. The limits of the revised Agreement extend on the north to the Madera County line. A dedication of those portions of City-owned Roeding Park parcel (APN 450-02-08T) is required to allow the PG&E to relocate a gas main from the existing Olive Avenue interchange to Roeding Park and follow the existing overhead power pole line on the northwesterly side of the park near West Avenue. Public Works staff has determined the required dedication area necessary for the construction of the public utilities for the Project, as shown in the Resolution's Exhibits "A", and "B". Adopting the Resolution authorizes the Public Works Director, or designee, to complete the dedication process. The City Attorney's Office has reviewed and approved the attached Resolution as to form. ENVIRONMENTAL FINDINGS The Environmental Impact Report (EIR)/Environmental Assessment (EA) and the NEPA Environmental Assessment with findings of No Significant Impact for the State Route 99, El Dorado to Clinton Rehabilitation project was adopted in February 2023. LOCAL PREFERENCE Local preference does not apply because the dedication of a public utility easement does not involve bidding or contracting. FISCAL IMPACT The State Route 99, El Dorado to Clinton Rehabilitation project is located in Council District 3. The City is not contributing funds to the project.
