1. ***RESOLUTION - A Resolution of the Council of the City of Fresno adopting the 2nd Amendment to the Annual Appropriation Resolution (AAR) No. 2026-159 appropriating $191,400 for the addition of one (1) full-time sworn position in the Fire Department (Requires 5 Affirmative Votes) (Subject to Mayor's Veto)

RECOMMENDATION
Staff recommends that Council 1) adopt the 2nd Amendment to the AAR No. 2026-159 to appropriate $191,400; and 2) adopt the First Amendment to the PAR No. 2026-158 to add one (1) permanent, full-time sworn Fire Battalion Chief position and associated costs to the Fire Department.
EXECUTIVE SUMMARY
The proposed amendments will add one (1) permanent, full-time sworn Fire Battalion Chief position and associated costs to the Fire Department to ensure adequate staffing to meet current and anticipated vacancies within the department.
BACKGROUND
On or about January 31, 2022, the City and IAFF Local 202 for Unit 5 and Unit 10 mutually agreed upon numerous items in their settlement agreement for additional pay steps. While nearly all items identified have been addressed and completed, one item remains outstanding which adds an additional non-administrative Battalion Chief to mitigate battalion chief shift replacement. The language reads as follows, "a non-administrative battalion chief position or assignment will be added to mitigate battalion chief extra shift/shift replacement, effective fiscal year 2024 or as soon as practicable". The Fire Department respectfully requests authorization for one (1) Fire Battalion Chief position and associated appropriations. The addition of this position will satisfy the settlement agreement established in January 2022 and will assist in reducing shift replacement for the field Battalion Chief positions.
The approval of this amendment will allocate the appropriations needed in FY 2027 in the Fire Department.
The City Attorney's Office has approved the First Amendment to the PAR No. 2026-158 as to form. The Finance Department has reviewed this item.
ENVIRONMENTAL FINDINGS
This is not a "project" for the purpose of the California Environmental Quality Act ("CEQA") Guidelines Section 15378 and is therefore exempt from the CEQA requirements.
LOCAL PREFERENCE
Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.
FISCAL IMPACT
There will be an impact to the General Fund in FY 27. This AAR is requesting additional appropriations of $191,400.
