Approve the execution of the Agreement for Purchase and Sale of Real Property and Escrow Instructions for the sale of a 0.012-acre (540 square feet) City-owned parcel located on the west side of North Clark Street, south of East Buckingham Way, Assessor's Parcel Number (APN) 436-023-11T, in the amount of $2,997 to Jose Juan Beltran; and authorize the City Manager or designee to execute the Purchase and Sale Agreement, associated Grant Deed, and all necessary escrow documents for the transfer of the parcel ..Body RECOMMENDATIONS Staff recommends the City Council 1) adopt a finding of Categorical Exemption pursuant to Section 15312 (Class 12) of the California Environmental Quality Act (CEQA) Guidelines; 2) adopt the attached Resolution declaring a 0.012-acre (540 square feet) City-owned, undeveloped parcel located on the west side of North Clark Street, south of East Buckingham Way, identified as Assessor's Parcel Number (APN) 436-023-11T, to be exempt surplus land pursuant to California Government Code Section 54221 (f)(1)(B); and 3) approve the execution of the Agreement for Purchase and Sale of Real Property and Escrow Instructions and authorize the City Manager or designee to execute the Purchase Agreement and associated Grant Deed and escrow documents with Jose Juan Beltran for the transfer of the subject property. EXECUTIVE SUMMARY The City of Fresno owns a 0.012-acre (540 square feet) unimproved parcel located on the west side of North Clark Street, south of East Buckingham Way, identified as APN 436-023-11T (the "Subject Property"). The City acquired fee title to the parcel via Quitclaim Deed from the County of Fresno on June 19, 1990. The parcel is the site of the former Department of Public Utilities Pump Station 228, which was abandoned and sealed on May 28, 1996. Jose Juan Beltran (the Buyer), owns and occupies the residential parcel adjacent to the north and west of the Subject Property. The Buyer proposes to combine the Subject Property with his adjoining parcel to maintain it as part of his property. As such, the Subject property must be declared Exempt Surplus Land in order to proceed with the disposition of the land to the adjoining landowner pursuant to the Surplus Land Act. BACKGROUND The City of Fresno owns a 0.012-acre (540 square feet) unimproved parcel located on the west side of North Clark Street, south of East Buckingham Way, identified as APN 436-023-11T. The City acquired fee title to the parcel via Quitclaim Deed from the County of Fresno on June 19, 1990, specifically for use as a pump station. The Subject Property no longer contains an active Department of Public Utilities (DPU) pump station; the pump station was abandoned and sealed on May 28, 1996, and therefore is no longer of use to the City. Jose Juan Beltran (the Buyer), owner and occupant of the adjacent residential parcel, has proposed to combine the Subject Property with his parcel to maintain it as part of his property. City Staff (Staff) determined the value of the Subject Property to be $2,997, based on recent comparable sales. The Buyer concurred with this valuation and signed the Purchase and Sale Agreement on July 16, 2026. Staff recommend that the City Council authorize the City Manager or designee to execute the Purchase and Sale Agreement, the Grant Deed, and all necessary escrow documents to complete the transfer of the Subject Property. The City will dispose of this portion of land in accordance with the Surplus Land Act. The City Attorney's Office has approved the attached Resolution and Purchase and Sale Agreement as to form. ENVIRONMENTAL FINDINGS Staff has performed a preliminary environmental assessment of the project and has determined that the sale of the property is exempt from CEQA as set forth in CEQA Guidelines, Section 15312 (Class 12) - Surplus Government Property Sales, which exempts projects from CEQA requirements if the property is not located in an area of statewide, regional, or areawide concerned identified in Section 15206(b) (4). The subject parcel does not fall within such area; therefore, the sale qualifies under this exemption. The proposed agreement would transfer title to the owner of the adjacent parcel. No development, physical improvements, or changes to the property are proposed. None of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply. Furthermore, the proposed project is not expected to have a significant effect on the environment. Accordingly, a categorical exemption, as noted above, has been prepared for the project. LOCAL PREFERENCE Local preference was not considered because this item does not include a bid for or award of a construction or services contract. FISCAL IMPACT This vacation is located in Council District 4, and no general funds will be used in this process. All proceeds from the sale will be deposited into the Water Enterprise Fund.
