EXECUTIVE SUMMARY Sculpture Conservation Studio was awarded a service agreement by Council on October 31, 2024, for art conservation services for artwork located on Fulton Street, Convention Center, and Mariposa Mall. This agreement is set to expire on June 30, 2026. General Services Department is now seeking to amend the agreement to increase the budget to encompass 24 of the 25 artwork pieces and extend the contract through June 30, 2027. General Services will return to Council in FY 2027 to add the one remaining artwork to the agreement for conservation. General Services shall utilize funding appropriated for Fulton Street, Convention Center, and Mariposa Mall artwork maintenance in the Department of Public Works adopted FY2026 budget. BACKGROUND As part of the Fulton Mall Reconstruction Project, the City invested roughly $1.8 million to restore artwork located on Fulton Street that were in conditions ranging from stable to poor. The dedication for the re-opening of Fulton Street was on October 21, 2017, at which point the artworks and fountains were in good condition. However, due to calcium and other minerals in the fountain water, rain, dust, vehicle, and other forms of pollution, the condition of the artworks' appearance continues to degrade. In 2019 Sculpture Conservation Studio was contracted to evaluate the condition of these pieces and perform recommended maintenance. Due to this history of quality performance and their familiarity with the artwork, Sculpture Conservation Studio has been determined to be uniquely qualified to perform this maintenance and conservation. All work performed by Sculpture Conservation Studio has conformed to the strictest conservation standards and guidelines by the AIC, and with the United States Department of Interior's Standard for Historic Buildings. Council approved the original agreement on October 31, 2024. On April 21, 2025, the City and Sculpture Conservation Studio entered into a First Amendment, removing and reclassifying two artworks as Public Works of Improvement, reducing the original total not-to-exceed fee by $23,000. On July 1, 2025, the Second Amendment was executed extending the contract through June 30, 2026. Staff now recommends a Third Amendment to the Agreement to extend the term through June 30, 2027, and increase the monetary consideration in an amount not-to-exceed $100,000 for the conservation of additional artwork, increasing the total agreement to an amount not-to-exceed $352,000. The City Attorney has reviewed and approved to form. Furthermore, Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. Staff recommends Council, adopt finding of a Categorical Exemption per staff determination, pursuant to Section 15301 of the CEQA Guidelines for the Artwork Conservation Project. LOCAL PREFERENCE Local preference is not applicable because the service provider is uniquely qualified. FISCAL IMPACT General funds will be used to fund these conservation efforts.
