This amendment is necessary to support the implementation of the City's expanded US EPA Brownfields RLF Supplemental Grant award of $500,000, which enables one to two additional cleanup loans during the period of performance. Also, recommend authorizing the City Manager or designee to sign the amendment and all related documents. EXECUTIVE SUMMARY The City received an increase of $500,000 to its US EPA Brownfields RLF Supplemental Grant award on July 9, 2026, expanding available funding for cleanup loans and associated regulatory compliance activities. The increased award is expected to support one to two additional RLF loans during the period of performance. The First Amendment to the Consultant Services Agreement with Stantec Consulting Services Inc. increases spending authority and extends the agreement term to ensure consultant services remain available throughout the full EPA grant period. BACKGROUND The executed Consultant Services Agreement, effective October 10, 2024, was established to obtain professional environmental consultant services for the US EPA Brownfields RLF Supplemental Grant. The agreement authorized a not-to-exceed amount of $101,750 and a term through December 31, 2027. On July 9, 2026, the US EPA publicly announced additional RLF Supplemental Grant awards nationwide, including an increase to the City of Fresno's allocation. This expanded funding supports additional cleanup loans and requires continued technical, regulatory, and compliance assistance to meet federal requirements. The increased award is expected to support one to two additional RLF loans during the period of performance. The First Amendment increases the contract amount by $100,000, for a total not-to-exceed amount of $201,750, and extends the agreement term to December 31, 2030, aligning consultant services with the full EPA grant period. The expanded RLF Supplemental Grant award increases the number of cleanup projects the City can finance, requiring additional consultant support for loan underwriting, environmental review, regulatory coordination, and federal reporting. The amendment ensures Stantec remains available to support implementation of one to two additional RLF loans funded through the increased EPA award. All other terms and conditions of the original agreement remain unchanged. ENVIRONMENTAL FINDINGS Approval of this professional services agreement does not constitute a project under the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines Section 15378, as it does not result in a direct physical change to the environment. LOCAL PREFERENCE Local Preference does not apply because this procurement was conducted as a qualifications-based selection under Fresno Municipal Code Section 4-107 and Administrative Order (AO) 6-19. FISCAL IMPACT There is no impact to the General Fund. This amendment is funded through the US EPA Brownfields RLF Supplemental Grant.
