Approve a Reimbursement Cooperative Agreement with the California High Speed Rail Authority (CHSRA) for $350,000 to reimburse the City for expenses related to the realignment of "G" Street and authorize the Director or his designee to execute an amendment up to a maximum amount of $3,200,000 ..Body RECOMMENDATION It is recommended that the Council adopt the 2nd Amendment to the Annual Appropriations Resolution No. 2016-118 appropriating $350,000 for the realignment of "G" Street between East California and Santa Clara Street; and approve the attached Reimbursement Cooperative Agreement between the City of Fresno and the CHSRA, subject to final approval as to form by the City Attorney's Office, up to the amount of $350,000 to cover expenses incurred by the City resulting from the design for the realignment of "G" Street between East California Avenue and Santa Clara Street; and authorize the Public Works Director or his designee to sign an amendment up to a maximum amount of $3,200,000 for the total project, which includes design, bid, contract award and construction, on behalf of the City. EXECUTIVE SUMMARY In order to mitigate impacts to the Fresno Rescue Mission, the CHSRA has agreed to pay for the realignment of "G" Street to accommodate a reconfigured site for their facilities. The City of Fresno has negotiated a "G" Street Reimbursement Cooperative Agreement for a two phased project with the CHSRA. Approval by the Council will allow the agreement to be executed subject to City Attorney approval as to form. The first phase will be for the design of the "G" Street realignment with the second phase being the bid, contract award and construction phase. Upon completion of the design phase, the Council approved amendment will be executed. Due to the Authority's funding structure, the Authority can encumber only funding for the design phase at this time. The attached amendment will allow funding for construction of the project and makes no other changes to the agreement, which contains all other terms necessary for both phases. Staff will return to the Council for approval to award the construction contract and construct the "G" Street realignment. BACKGROUND On May 3, 2012, the Council approved a Memorandum of Understanding with the CHSRA to develop a series of Cooperative Agreements between the CHSRA and the City of Fresno. The current Agreement will address a request by CHSRA, that the City undertake the work to realign "G" Street. The attached Reimbursement Cooperative Agreement, reflecting a two phased project, is now ready for the Council to consider approving. The scope of the Agreement requires the City to relocate all utilities that conflict with the construction of the new "G" Street alignment along that portion of "G" Street between East California Avenue and Santa Clara Street so that services provided by the affected utilities are not interrupted by the realignment of "G" Street. All relocation and realignment work will comply with the City's Construction Standard's and Specifications. Due to the location of the high speed rail corridor alignment which abuts "G" Street, the present location of the Fresno Rescue Mission (FRM) on the east side of "G" Street must now relocate to the west side of "G" Street. As part of the FRM mitigation CHSRA has agreed to realign "G" Street to facilitate the relocation of all the FRM facilities to the west side of "G" Street. Because the City can implement and complete the realignment construction more quickly and effectively, thus minimizing the impact on the surrounding businesses and traffic flow, the CHSRA has requested the City to undertake the "G" Street realignment and has agreed to reimburse the City for all expenses associated with the realignment. In consideration for the City's undertaking CHSRA will reimburse the City up to $350,000 for the phase one design work and up to a maximum total amount of $3,200,000 for the total project. ENVIRONMENTAL FINDINGS CHSRA has completed the required Environmental Impact Studies for the high-speed rail corridor through Fresno. LOCAL PREFERENCE Not applicable because this is not a competitive bid award. FISCAL IMPACT There will be no impact to the General Fund or any City operating funds associated with the recommended action. All City costs for services provided under this agreement will be paid for by the California High Speed Rail Authority.
