RECOMMENDATION
Staff recommends City Council adopt a finding of Categorical Exemption pursuant to Section 15301(c) Class 1 of the CEQA Guidelines, award a construction contract in the amount of $358,000 to VSS International, Inc., from West Sacramento, California, as the lowest responsive and responsible bidder for the E. Butler Avenue Bike Lane from S. Hazelwood Boulevard to S. Peach Avenue Project (Project) and authorize the Public Works Director or designee to sign the contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno seeks to install bike lanes on E. Butler Avenue between S. Hazelwood Boulevard to S. Peach Avenue. The proposed Project consists of a slurry seal treatment and re-striping Butler Avenue between Hazelwood and Peach Avenues to create a Class II Bike Lane. The Project will continue to result in efficient traffic flow, with an added air quality benefit by providing cyclists a dedicated path of travel along the Project route. The project is being funded by Measure "C" Bike Lane funds along with a grant from the Active Transportation Program (ATP).
BACKGROUND
In May 2014, the Council adopted a resolution authorizing applications for ATP grant funding. The Butler Avenue project was approved for funding through Fresno COG's regional ATP funding cycle.
Public Works Department staff prepared construction contract documents for the Project. The Project includes slurry seal, crack sealing and re-striping Butler Avenue between Hazelwood and Peach Avenues to create a Class II Bike Lane and improve air quality by providing cyclists a dedicated path of travel.
On September 14, 2016, a Notice Inviting Bids was posted on the City's website and faxed to eleven (11) building exchanges. Construction contract documents were distributed to nine prospective bidders. Five sealed bids were received and opened in the public bid opening on October 18, 2016. The total bid proposal prices ranged from $358,000 to $554,130.
VSS International, Inc. submitted the bid in the amount of $358,000, for the Project. The bid is 15% below the Project's construction allocation and is considered a responsive and responsible bid. The staff determination was posted on the City's website site on October 25, 2016.

ENVIRONMENTAL FINDINGS
Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(c) of the CEQA Guidelines. This section exempts the repair, maintenance, or minor alteration of existing structures or facilities, including existing streets, sidewalk and gutters. The work of this Project will only include modification of curb ramps to ADA compliance, rehabilitation of the asphalt pavement surface, striping and pavement markings, replacement of traffic loop detectors, minor concrete work and no further expansion of existing use. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project. Staff recommends that the Council, based upon its own independent judgment, adopt a finding of Categorical Exemption, pursuant to Section 15301(c), Class 1 of the CEQA guidelines for the proposed Project.
LOCAL PREFERENCE
The local preference was not implemented because this Project is utilizing Federal grant funds.
FISCAL IMPACT
The Project is located in Council District 5. The overall budget for the Project is $511,500 and is funded by $197,000 in Federal ATP Regional funds and $314,500 in Measure "C" Bike Lane funds. The Project will not have any impact to the General Fund. Of the overall budget of the Project, $358,800 will be used for the construction contract award.
