Approve Memorandum of Understanding with Stephen Investments Inc. (Pilibos Bros.) for the construction of pedestrian entry gates at Pilibos Park (District 5). 2. ***RESOLUTION - 29th amendment to the Annual Appropriation Resolution (AAR) No. 2017-165 appropriating $15,000 from Stephen Investments Inc. (Pilibos Bros.) through Fresno United Neighborhoods 501 c(3) Non-Profit to fund a portion of the Pilibos Park project. (Requires 5 affirmative votes) (Subject to Mayor's Veto) ..Body RECOMMENDATION Staff recommends that Council: (1) approve a Memorandum of Understanding (MOU) with Stephen Investments Inc. (Pilibos Bros.) for the construction of pedestrian gates at Pilibos Park; and, (2) adopt the 29th amendment to the Annual Appropriation Resolution No. 2017-165 to appropriate $15,000 from Pilibos Bros. through the Fresno United Neighborhoods 501 c (3) non-profit to partially fund the Pilibos Park project. EXECUTIVE SUMMARY Pilibos Brothers Inc., has requested to partner with the City of Fresno PARCS department to construct several entry/exit gates along the perimeter of Pilibos Park - one (1) set at the main entrance (south side) and a set at both the east and west side of the park. The estimated cost for the project is $20,000. Stephen Investments Inc. and Pilibos Brothers Inc., has offered to donate $15,000 for said project. District 5 has committed $5,000 to cover the project funding gap, and PARCS staff has committed to provide in-kind project support with administrative oversight and general assistance with construction. BACKGROUND In 1996, Pilibos Brothers Inc., donated 13.29 acres of land, located at 4945 E. Lane Avenue, to the City of Fresno for the purpose of developing a community park in southeast Fresno. The park was developed under the leadership of former District 5 Councilmember, Sal Quintero, Landscape Designe,r Bob Boro, Fresno Pacific University Men's Soccer Coach, Jaime Ramirez, and Pilibos Brothers Inc. Upon completion of the park in 1999, the Pilibos Family made the commitment to provide on-going support and to continue park improvement as needed, and resources were available. In 2016, Sarah Pilibos, President with Stephen Investments Inc. and Pilibos Bros. approached the City to make the offer to partially fund a fencing project in partnership with Council District 5 and PARCS that would add main entrance automobile entry/exit sliding gates as well as pedestrian entry/exit gates. The proposed project would address access issues while improving security and minimize vandalism to the park. The fencing project will allow the park to be "closed" and secure the park after operational hours for neighborhood safety and security. Under the terms of the MOU, the City will: * Serve as the project manager and lead the purchasing and installation process, which includes, but is not limited to assurance of proper permits, construction, and inspection. * Provide $5,000 toward the fencing project. * PARCS will provide on-going maintenance of the fence and entry gates. * Work commencement and completion no later than 4 months upon date of donation. Stephen Investments Inc. and Pilibos Bros. will: * Donate $15,000, through Fresno United Neighborhoods, for the Pilibos Park fencing project. * Engage in the Adopt-A-Park Program to provide supplemental maintenance assistance to the overall park site. The partnership with Stephen Investments Inc. and Pilibos Bros. Inc. and subsequent MOU have been reviewed and approved by the City Attorney and Risk Management Offices. ENVIRONMENTAL FINDINGS The proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to Guideline Section 15304, which exempts minor public private alterations in the condition of land, water and/or vegetation which does not involve removal of healthy, mature scenic trees. The proposed project is consistent with this exemption, and none of the exceptions to Categorical Exemptions set forth in the CEQA Guideline, Section 15300.2 apply to this project. Therefore, no further environmental review is required. LOCAL PREFERENCE Local preference is not applicable to this item because this item does not include the award of a construction or consultant contract. FISCAL IMPACT Council District 5 is allocating $5,000 of discretionary park improvement project funding that was included as part of the adopted Fiscal Year 2018 Budget.
