Adopt finding of a Categorical Exemption pursuant to Section 15301(d) of the California Environmental Quality Act (CEQA) Guidelines 2. Award a construction contract with Davis Moreno Construction, Inc. of Fresno, CA, for $519,799 for the Frank H. Ball Swimming Pool Renovation Project ..Body RECOMMENDATIONS Staff recommends that Council adopt a finding of a Categorical Exemption and award a construction contract with Davis Moreno Construction, Inc., for $519,799 for the Frank H. Ball Swimming Pool Renovation project and authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno. EXECUTIVE SUMMARY On December 10, 2015, the PARCS Department received a correction letter from the County of Fresno Department of Public Health listing several items that required addressing at Frank H. Ball Swimming Pool. The items listed in the December 2015 letter are the basic requirements to obtain the permit to operate from the County Department of Public Health. This construction contract with Davis Moreno Construction, Inc. will allow the completion of the items on the correction letter enabling the issuance of the permit to operate. BACKGROUND In October of 2015, two Registered Environmental Health Specialists from the County of Fresno Department of Public Health conducted onsite reviews with City staff of several City operated public swimming pools, one of those being the Frank H. Ball Swimming Pool. On December 10, 2015, the PARCS Department received a correction letter from the County of Fresno Department of Public Health listing several items that required addressing at Frank H. Ball Swimming Pool to bring the swimming pool into compliance with the California Health and Safety Swimming Pool Regulations. Funds were budgeted to address the situation, allowing staff to prepare and enter into a consulting services agreement for the design and preparation of construction documents for the Frank H. Ball swimming pool renovation project. Plans and specifications were prepared by Jones & Madhavan Architecture Engineering. A Notice Inviting Bids was published on February 8, 2017, distributed to ten building exchanges and posted on the City's website. The specifications were distributed to six prospective bidders. Five sealed bid proposals were received and opened in a public bid opening on March 7, 2017, with the bid amounts ranging from $498,500 to $1,092,490. Staff is recommending that Council adopt a finding of a Categorical Exemption and award a construction contract to Davis Moreno Construction, Inc. of Fresno, CA, for $519,799 for the Frank H. Ball Swimming Pool Renovation; and to authorize the Public Works Director or designee to sign and execute the standardized contract on behalf of the City of Fresno. The low bidder was bypassed due to the local preference requirements. ENVIRONMENTAL FINDINGS Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(d) of the CEQA Guidelines, which exempts restoration or rehabilitation of deteriorated or damaged structures, facilities or mechanical equipment to meet current standards of public health and safety. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. Staff recommends that the Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Section 15301(d), Class 1 of the CEQA Guidelines for the Frank H. Ball Swimming Pool Renovation Project. LOCAL PREFERENCE Local preference was implemented to Davis Moreno Construction, Inc. to award the construction contract for Frank H. Ball Swimming Pool Renovation. FISCAL IMPACT The Frank H. Ball Swimming Pool Renovation project was included in the approved FY17 PARCS Budget and is being funded by Prop 1C Funds.
