REPORT TO THE CITY COUNCIL June 22, 2017 FROM: STEVE BRANDAU, Councilmember, District 2 City Council Offices SUBJECT ..Title RESOLUTION - Initiating a text amendment to Fresno Municipal Code sections 15-2009(F) and 15-2010(I), relating to security and electric fences ..Body RECOMMENDATION Approve the Resolution of Initiation for a text amendment to Fresno Municipal Code sections 15-2009(F) and 15-2010(I), relating to security and electric fences. EXECUTIVE SUMMARY Sections 15-2009(F) and 15-2010 of the Fresno Municipal Code (FMC) set forth requirements for security and electric fences in the City. Prior to the installation of security or electric fences, the FMC currently requires a property owner to obtain a permit and execute a covenant to indemnify the City against all claims relating to the fencing. The Resolution of Initiation proposes to initiate a text amendment that will allow security and electric fence owners to execute an indemnity agreement with the City for all fence-related claims and remove the requirement for property owners to execute a covenant. The attached draft shows the proposed amendments to the Fresno Municipal Code. ENVIRONMENTAL FINDINGS This action is not a project pursuant to CEQA Guidelines 15378 LOCAL PREFERENCE N/A FISCAL IMPACT None. Attachments: Resolution Draft Ordinance
