Authorize the Chief of Police to revise the approved agreement with Fresno Unified School District to provide eleven student resource officers at 95 percent of the actual officers' cost, a police sergeant at 90 percent of the actual sergeant's cost, plus administrative fees and the vehicle lease costs of twelve patrol vehicles for an annual total of $1,588,350. 2. ***RESOLUTION - 7th amendment to the Annual Appropriation Resolution (AAR) No. 2018-157 appropriating $222,100 for twelve patrol vehicles for Student Resource Officers under the Fresno Unified School District and one patrol vehicle for a Student Resource Officer under the Fresno County Superintendent of Schools agreement. (Requires 5 affirmative votes) (Subject to Mayor's veto) ..Body RECOMMENDATIONS It is recommended that Council authorize the Chief of Police to revise the approved agreement with Fresno Unified School District to provide eleven school resource officers at 95 percent of the actual officer's cost, a police sergeant at 90 percent of the actual sergeant's cost, plus administrative fees and the bi-annual lease costs of twelve patrol vehicles for a total payment to City of $1,588,350. It is also recommended that Council approve the 7th amendment to the Annual Appropriation Resolution (AAR) No. 2018-157 appropriating $222,100 to fund costs of the Student Resource Officers under the Fresno Unified School District and the Fresno County Superintendent of Schools agreement, as well as vehicles for these officers. EXECUTIVE SUMMARY The Chief of Police and the Fresno Unified School District have agreed to revise the contract from 100 percent to 95 percent of the officers' cost and provide the Chief of Police discretion in assignment of the Student Resource Officers (SRO) when school is not in session. The Fresno Unified School District (FUSD), in an effort to provide a safe learning environment for students attending district high schools and middle schools, has agreed to fund eleven Student Resource Officers at 95 percent and one Sergeant at 90 percent of the Police Department's actual rates from July 1, 2018 to June 30, 2021. BACKGROUND In August of 1993, the Police Department and FUSD established a Memorandum Of Understanding to have a Student Resource Officer Program at local area High Schools. The success of the Student Resource Officer Program showed that students can build trust relationships with law enforcement officials where officers participate in mentoring, counseling and restorative justice practices at school sites. On May 24, 2018, City Council approved a contract with the Fresno Unified School District to fund eleven Student Resource Officers at 100 percent, however the Chief of Police and the Superintendent of FUSD have agreed to revise the contract from 100 percent to 95 percent of the officers' cost and provide the Chief of Police discretion in assignment of the SROs when school is not in session. FUSD will fund $1,523,200 for 95 percent of the cost of eleven officers and 90 percent of the cost of one police sergeant, plus $350.00 for administrative fees during fiscal year 2019. The remaining 10 percent of the police sergeant costs are paid by other contracted school districts. In addition to these costs, FUSD will fund the lease payments of twelve patrol vehicles in the amount of $129,600 per year for five years, with the first payment occurring during fiscal year 2019 in an amount not-exceed $64,800. Total cost for fiscal year 2019 is $1,588,350. The eleven SROs will perform regular duty law enforcement services. Ten SROs will be assigned to the district's high schools (Edison, Roosevelt, Fresno, McLane, Duncan, Phoenix Secondary, Hoover, Sunnyside, Cambridge, Bullard) located in Fresno. The eleventh SRO is assigned to Fort Miller middle school located in Fresno. Assignment is during the standard school year and normal hours of operation; subject to the availability of the SRO. For purposes of the attached agreement, "availability" shall be at the sole determination of the Chief of Police, or designated representative, taking into consideration any factors including, without limitation, health of officer, shortage of manpower, funding, and duty assignment of officer(s) to higher priority matters. However, in specific instances of the SRO taking personal leave or FPD approved law enforcement training; another available police officer will be assigned temporarily at the schools during such leave or training. On May 24, 2018 City Council approved the contract with the Fresno County Superintendent of Schools (FCSS), to fund one Student Resource Officer at 100 percent of the Police Department's actual rates from July 1, 2018 to June 30, 2021. The 7th Amendment to the AAR 2018-157 includes the payment of $5,400 for one semi-annual vehicle lease payment for FCSS. The City intends to finance this vehicle, as well as the twelve vehicles for FUSD under the City's Master Equipment Lease Purchase Agreement. Payments for all thirteen vehicles will be financed for five years with annual lease payments not-to-exceed $140,400 per year. ENVIRONMENTAL FINDINGS: This is not a "project" for the purposes of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378. LOCAL PREFERENCE: Local Preference was not considered because accepting funding from the State does not include a bid or award of a construction or services contract. FISCAL IMPACT FUSD will fund operational costs for the Fresno Police Department's SRO program for the period of July 1, 2018 to June 30, 2021. Operational costs include 95 percent of eleven police officers and 90 percent of one Sergeant, administrative fees, and the bi-annual lease payments for twelve patrol vehicles.
