REPORT TO THE CITY COUNCIL October 11, 2018 FROM: WILMA QUAN SCHECTER, City Manager Mayor/City Manager's Office SUBJECT ..Title ***RESOLUTION - Amending the Transparency in City Government Act (Subject to Mayor's veto) ..Body RECOMMENDATION It is recommended Council adopt the amendment to the Transparency in City Government Act. EXECUTIVE SUMMARY The Transparency Act currently limits the offer of severance to Unit 2 employees, and only by contract. Occasionally it would benefit the City to have the option to offer severance in the settlement of a claim or potential claim by a City employee who does not have a contract. The attached changes to the Transparency Act will allow for this option, in exchange for the employee's execution of a full release in compromise of a claim or potential claim. BACKGROUND The Transparency in City Government Act was co-authored by then-Councilmember Lee Brand and former Councilmember Henry T. Perea, and approved on a 7-0 vote in 2010. The Act was amended in 2015 to improve the transparency in employee compensation and disclosure, enhance the Council's authority over approving employee bonuses, and toughen the enforcement of the Act in the future.
