REPORT TO THE CITY COUNCIL August 15, 2019 FROM: DOUGLAS SLOAN, City Attorney City Attorney's Office SUBJECT: FMC amendments to implement transfer of code enforcement functions ..Title ***BILL NO. B-18 - (Intro. 7/25/2019) (For adoption) - Amending Sections 1-302, 1-305(d), 7-910(b), 10-704(b), 10-1602(a), 10-1609, and 11-304(c) of the Fresno Municipal Code related to code enforcement. (Subject to Mayor's veto) ..Body RECOMMENDATION Adopt ordinance amending sections 1-302, 1-305(d), 7-910(b), 10-704(b), 10-1602(a), 10-1609, and 11-304(c) of the Fresno Municipal Code related to code enforcement. EXECUTIVE SUMMARY On June 27, 2019, the Council adopted FY 2019 - 2020 budget, which included transferring code enforcement functions to the City Attorney's Office. These code changes are to update the code to be consistent with that action. BACKGROUND The proposed FMC changes are as follows: 1. Where the Director or City Manager has authority to enforce the code or approve regulations to implement or interpret the code, such authority shall also be granted to the City Attorney. 2. Along with other specified department directors, the City Attorney will have authorization to issue criminal citations. 3. The City Attorney (currently the City Manager) may approve code enforcement compliance agreements. 4. The City Attorney shall make rules and regulations for rental housing inspections. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a "project" and is therefore exempt from the California Environmental Quality Act requirements. LOCAL PREFERENCE Local preference was not considered because this Ordinance does not include a bid or award of a construction or service contract. FISCAL IMPACT None. Attachment: Ordinance
