Approve first amendment to the December 19, 2013 Lead Agency Operation of Universally Accessible Park Agreement with Resources for Independence Central Valley

RECOMMENDATIONS
Staff recommends that the City Council approve the attached amendment to modify the Lead Agency Operation Agreement with Resources for Independence Central Valley (RICV) to return the liability responsibility of the Universally Accessible Park (UAP) skate park and the dog park to the City.
EXECUTIVE SUMMARY
The attached amendment modifies the existing agreement between RICV and the City of Fresno. This amendment will relieve RICV of any liability for the skate park and dog park amenities at the UAP. The maintenance and operation for these two amenities will continue to be the responsibility of RICV. The dog park and skate park will require a weekly inspection from a PARCS Planned Maintenance staff.
BACKGROUND
While RICV was in the process of purchasing insurance for the operation and maintenance of UAP, estimates for the skate park and dog park amenities were excessive and would prohibit their ability to effectively manage and operate the entire park. Once the estimates were received, RICV communicated its financial concerns with the City and requested the City of Fresno to assume the liability of the skate park and dog park to help RICV reduce the insurance premiums for the operation of the remainder of the park. While the dog and skate park liability will be the responsibility of the City of Fresno, RICV will continue to maintain and operate the dog park and skate park.
ENVIRONMENTAL FINDINGS
By definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 this item does not qualify as a "project" as defined by CEQA.
LOCAL PREFERENCE
Not implemented because this item does not include a bid or award of a construction or services contract.
FISCAL IMPACT
The City's estimated annual impact to the General Fund to inspect the dog park and skate park on a weekly basis is $2,200.
