HERR, Assistant Director Public Works Department, Facilities and Construction Management Divisions BY: ROBIN O'MALLEY, Public Works Manager Public Works Department, Facilities Management Division SUBJECT ..Title RESOLUTION - Directing the City Manager to delay construction of the fence prescribed relating to the construction of security fencing for City Charter Officials. ..Body RECOMMENDATIONS Staff recommends that the City Council approve a resolution directing the Administration to delay the construction of the fence described in Resolution No. 2020-035 until such time that the declaration of a Local Emergency is lifted and impacts of the COVID19 world-wide pandemic to the City's FY 2020 and FY 2021 budgets and emergency reserve fund are fully assessed and addressed. EXECUTIVE SUMMARY In light of the COVID19 world-wide pandemic and the impact on the City's General Fund by the current shelter in place order, staff recommends that Council direct the administration to delay the construction of the fence described in Resolution No. 2020-035. BACKGROUND On February 13, 2020, via Ordinance No. 2020-004, Council approved changes to Section 9- 2601 of the Fresno Municipal Code providing for security of City Hall and other City facilities. 2601 (m) stated that "In furtherance of City Hall security, that area of the City Hall parking lot providing for parking for charter officials shall be fenced and gated, and admission to that area shall be limited to charter officials and their vehicles, along with anyone accompanying the charter official." On February 27, 2020, via Resolution No. 2020-035, Council directed that the provisions of 9- 2601 be further implemented in that the construction of the fence described in 9- 2601( m), be constructed as soon as the procurement and construction process can take place, and Council be kept informed of the progress and anticipated timeline of completion. On April 28th, the City entered into an agreement with an Electrical Engineer for the design. Full plans are expected by July 3rd. On March 04, 2020 Governor Newsom Declared at State of Emergency to help the State prepare for broader spread of COVID-19, on March 11, 2020, the World Health Organization declared a COVID19 world-wide pandemic, and on March 16, 2020 Mayor Brand declared a Local Emergency, ratified by the Council. Council was made aware on April 23rd that FY20-21 projected General Fund revenues, the funding source for the construction, are being impacted by the current shelter in place order and closure of non-essential businesses and the Council directed staff to look at every opportunity to find cost savings to prevent reduction in services. Staff recommends that Council directs the administration to delay the construction of the fence described in Resolution No. 2020-035 until such time that the declaration of a Local Emergency is lifted and impacts of the a COVID19 world-wide pandemic to the City's FY 2020 and FY 2021 budgets and emergency reserve fund are fully assessed and addressed. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a "project" as defined by the California Environmental Quality Act. LOCAL PREFERENCE Local preference does not apply to this resolution. FISCAL IMPACT General Fund dollars would not be spent at this time. Attachment: Resolution
