Award a construction contract in the amount of $242,303.00 to Seal Rite Grading and Paving of Fresno, CA, as the lowest responsive and responsible bidder for the Ashlan Avenue Sidewalks from Effie Street to State Route 41 Project ..Body RECOMMENDATIONS Staff recommends that City Council approve the 54th Amendment to the Annual Appropriation Resolution No. 2020-159. Appropriating $193,400.00 for the Ashlan Avenue Sidewalks project, award a construction contract with Seal Rite Grading and Paving of Fresno, CA, in the amount of $242,303.00 as the lowest responsive and responsible bidder, and authorize the Public Works Director or Designee to sign a standardized contract on behalf of the City. EXECUTIVE SUMMARY Ashlan Avenue, between Effie Street and State Route 41, is missing concrete sidewalk on both sides of Ashlan. These segments of pedestrian paths of travel provide connectivity to the existing sidewalks west and east of this project which lead to schools, shopping and retail locations east and west of the freeway. This proposed project will infill these gaps in the sidewalk infrastructure and reconstruct the existing drive approaches to provide a continuous ADA-compliant path of travel along both sides of Ashlan Avenue. Other work includes upgrading the existing pedestrian crossing at the southbound State Route 41 ramps with audible pedestrian pushbuttons. One curb ramp within the project limits will also be upgraded to conform to current accessibility standards. This sidewalk construction project is funded through the Active Transportation Program (ATP) grant with required local match through the pedestrian and bike fund and supplemental funding through the SB1 gas tax fund. BACKGROUND The design phase of this project was initiated in FY2019 and the construction phase was budgeted in the Council-adopted FY2020 Capital Budget. Department of Public Works staff designed the project, which took approximately 12 months to complete. The scope of work for the Ashlan Avenue Sidewalks project includes, constructing curb, gutter, sidewalk, drive approaches, minor on-site driveway reconstruction, minor landscaping restoration, and curb ramp construction. This project includes installation of an Accessible Pedestrian Signal system (APS) at the existing traffic signal at Ashlan Avenue and State Route 41 on and off ramps. This project is on both sides of Ashlan Avenue from Effie to State Route 41. Staff prepared a Notice Inviting Bids, which was published in the Fresno Business Journal on October 9, 2020, posted on the City's website, and faxed to twelve (12) building exchanges. Project plans and specifications were distributed to nine (9) potential bidders. Five (5) sealed bid proposals were received and opened in a public bid opening on November 10, 2020, with bids ranging from $242,303.00 to $375,730.00. Seal Rite Grading and Paving of Fresno, CA, with their bid of $242,303.00, was determined to be the lowest responsive and responsible bidder. The expiration date of the bids has been extended and is now February 12, 2021. If the bids are rejected or expire, the project must be rebid which will result in a delay of approximately 60 days. The City Attorney's Office has reviewed and approved as to form the proposed Standardized Construction Contract. Staff recommends that Council approve a construction contract to Seal Rite Grading and Paving of Fresno, CA, in the amount of $242,303.00 to construct the Ashlan Avenue Sidewalks from Effie Street to State Route 41 project. As the lowest responsive and responsible bidder, and to authorize the Public Works Director or designee to sign and execute the contract on behalf of the City of Fresno. ENVIRONMENTAL FINDINGS Staff has performed a preliminary environmental assessment of this project and that Categorical Exemption of Section 15301 was adopted by Fresno City Council on September 26, 2019. During a Council Action to consider and authorize a resolution of public use and necessity for acquisition of an easement and right of way for public purposes for a parcel within this projects improvement. LOCAL PREFERENCE The local preference was not implemented based on conditions of the State Active Transportation Program (ATP) grant. FISCAL IMPACT The Ashlan Sidewalks from Effie to State Route 41 Project is located in Council District 7. The overall cost of the project is $442,000.00 and is funded with a State grant from the Active Transportation Program (ATP). Required local match is covered by Pedestrian Bike funds and supplemental funding through the SB1 gas-tax fund. Of the total costs, $242,303.00 will be used for the construction contract award. Adoption of the attached AAR amendment resolution will appropriate the necessary funding to award the construction contract in the current fiscal year. Additional appropriations for the remaining project costs such as Construction Management inspection and testing will be included in the City's FY2022 budget.
