(Citywide) ..Body RECOMMENDATIONS Staff recommends that City Council approve the Second Amendment to the consultant services agreement between the City of Fresno (City) and V&A Consulting Engineers, Inc., (V&A)(Agreement), increasing the fee by $313,886 for a total contract amount not to exceed $535,287 including the balance of $14,926 remaining in contingency and extending the contract completion date from December 31, 2022 to December 31, 2023, to conduct comparative trials of different treatment systems within the sanitary sewer collection system to evaluate the impact in mitigating odors and corrosion prior to installation of permanent facilities; and authorize the Director of Public Utilities, or designee, to sign the Second Amendment on behalf of the City. EXECUTIVE SUMMARY The Department of Public Utilities, Wastewater Management Division (WMD), entered into an agreement with V&A to aid in resolving issues related to odor and corrosion within the City's sanitary sewer collection system. Prior to commencing design and construction of permanent treatment and control facilities, the WMD is proposing to conduct comparative trials of different treatment systems to evaluate the impact of the proposed strategies in mitigating odors and corrosion within the City's collection system. The Second Amendment, modifies the scope of services to include the equipment rentals and trials, and increases the fee by $313,886 for a total fee not to exceed $515,287 plus the balance of $14,926 remaining in contingency for a total contract amount of $535,287, and extends the contract completion date from December 31, 2022 to December 31, 2023. It is required that the comparative trials be implemented prior to the end of the summer months to capture the highest concentrations of hydrogen sulfide gas. A delay in approving the Second Amendment will result in missing the window of opportunity to capture the data required for a thorough evaluation. BACKGROUND The WMD is responsible for the collection, conveyance, treatment, and reclamation of wastewater generated by sewer customers in the Fresno-Clovis metropolitan area. Over 68 million gallons of wastewater is generated daily, and travels through the sanitary sewer collection system to the Fresno-Clovis Regional Wastewater Reclamation Facility located southwest of Fresno. The collection system is comprised of approximately 1,600 miles of sanitary sewer mains ranging in size from 6-inches to 84-inches in diameter, nearly 25,000 access structures (i.e. manholes and lampholes), and 17 sewer lift stations. A natural occurrence within the collection system is the production and release of odorous hydrogen sulfide gas which results in ongoing corrosion of collection system infrastructure. On February 9, 2021, the WMD entered into an Agreement with V&A in the amount of $201,401 plus a contingency of $20,000 to conduct an investigation of the City's existing sanitary sewer collection system and identify the sources that contribute to the production and emission of odorous and corrosive gas. Following the investigation, V&A completed an evaluation of the available treatment options and provided a recommendation as to the systems that would deliver the maximum cost-to-benefit ratio for effective odor and corrosion control at each source. On March 24, 2022, the City approved the First Amendment to the Agreement, expanding the scope of services to include site visits consisting of treatment system demonstrations featuring the recommended odor and corrosion control strategies currently in place at other municipalities. This effort utilized $5,074 of the allocated contingencies and increased the total fee to $206,475. The WMD is now proposing to implement the comparative trials of the recommended treatment and control measures within the City's sanitary sewer collection system. These trials will allow for evaluation of the impact that the proposed treatment options have in mitigating odors and corrosion within the City's collection system prior to acquiring property, finalizing design, and commencing construction of permanent treatment and control facilities. The Second Amendment will expand the scope of services to include two different treatment systems be installed at three separate locations throughout the City. The comparative trials will ensure that future expenditures related to the odor and corrosion control program have merit and conform to the City's collection system. The Second Amendment will increase the fee by $313,886 for a total fee not to exceed $515,287 plus the balance of $14,926 remaining in contingency for a total contract amount of $535,287, and extends the contract completion date from December 31, 2022 to December 31, 2023. It is required that the comparative trials be implemented prior to the end of the summer months to capture the highest concentrations of hydrogen sulfide gas. A delay in approving the Second Amendment will result in missing the window of opportunity to capture the data required for a thorough evaluation. The City Attorney's Office has reviewed the Second Amendment and approved as to form. Upon approval by City Council, the Second Amendment will be executed by the Director of Public Utilities, or designee. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the approval of this amendment does not qualify as a "project" for the purpose of CEQA. LOCAL PREFERENCE Local preference does not apply to this action because this is an amendment to an existing agreement. FISCAL IMPACT There is no impact to the General Fund. Funding for this work is included in the Wastewater Management Division's Capital Improvement Program budget within the Wastewater Enterprise Fund 40501.
