MASCIA, PE, Assistant City Manager Interim Director, Capital Projects Department PAUL AMICO, PE, Director Department of Public Utilities BY: JASON STARNES, PE, Assistant Director Capital Projects Department, Construction Management Division SUBJECT ..Title Approve Contract Change Order No. 03 with Harris Development Corporation, dba HBC Enterprises of Clovis, California, in the amount of $0.00 with forty-seven (47) additional working days for the Security Fence Improvements at Pump Stations 144, 165, and 174 Project - Project ID WC00074 (Bid File 12501995) (Council Districts 6, 7 and Fresno County) ..Body RECOMMENDATION Staff recommends the City Council approve Contract Change Order No. 03 with Harris Development Corporation, dba HBC Enterprises of Clovis, California, in the amount of $0.00 with forty-seven (47) additional working days to account for delays associated with design changes and project site access for the Security Fence Improvements at Pump Stations 144, 165, and 174 Project, and authorize the Capital Projects Department Director, or designee, to sign Contract Change Order No. 03 on behalf of the City of Fresno. EXECUTIVE SUMMARY On June 12, 2025, a Contract was awarded in the amount of $734,497.85 to Harris Development Corporation, dba HBC Enterprises of Clovis, California, for the Security Fence Improvements at Pump Stations 144, 165, and 174 Project to construct 10-1/2 ft high security fencing and access gates at Pump Stations 144, 165, and 174. City Council approval of Contract Change Order No. 03 in the amount of $0.00, with forty-seven (47) additional contract working days, will formally adjust the Contract Time to account for delays associated with design revisions, site access restrictions, and operational coordination encountered during construction. There will be no increase to the Contract Price under this Contract Change Order, as it is for additional contract working days only. BACKGROUND On June 12, 2025, a contract was awarded in the amount of $734,497.85 to Harris Development Corporation, dba HBC Enterprises of Clovis, California, for the Security Fence Improvements at Pump Stations 144, 165, and 174 Project. The project includes replacing gates at all 3 locations, replacing approximately 880 linear feet of fencing, and modifying approximately 470 linear feet of fencing. The scope of work also includes removal of old fencing, coordination with outside agencies as necessary, and new concrete mow strips where appropriate. The Contractor's Notice to Proceed was issued with a start date of October 22, 2025, and a contract completion date of January 21, 2026. There have been two (2) prior Contract Change Orders approved totaling $22,819.01, resulting in a revised contract total of $757,316.86. There have been no contract days added by the previously executed Contract Change Orders, nine (9) weather days and no suspension days, resulting in a revised contract completion date of February 3, 2026. This Contract Change Order adds forty-seven (47) additional working days to the contract time due to several design and coordination issues. Twenty-five (25) additional days are allocated for the delays associated with site availability, right-of-entry restrictions, and unresolved easement/property access issues at Pump Station 165 which impacted the Contractors sequencing and progression of work operations. Ten (10) days are allocated with the City-directed redesign of the fence topper attachment system and related fabrication, detailing, coordination, and installation impacts at Pump Station 144. Seven (7) days are allocated for delays associated with the following: gate track excavation conflicts, Request for Information (RFI) No. 3 review and response, revised gate post installation details, temporary re-compaction activities, and operational coordination. Five (5) days are allocated for delays associated with water leak repairs, waterlogged subgrade conditions, utility conflicts, and operational access restrictions impacting work activities at Pump Station 144. City Council approval of Contract Change Order No. 3 is required by Resolution 2017-158, which sets the approval thresholds for individual Contract Change Orders which exceed 1% of the total contract price or $100,000.00 and for individual Contract Time extensions which by themselves or when aggregated with time increases under previous Change Orders, equals up to thirty (30) days or 20 percent (20%) of the total time allowed under the Contract, whichever is greater. There will be forty-seven (47) additional working days added to the contract time by this Contract Change Order. With forty-seven (47) change order days, nine (9) weather days, and no suspension days, the resulting revised contract completion date is April 10, 2026. The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract as the contract amount is less than $1 million, pursuant to the terms of the PLA. Funding for this project is provided through the Water Enterprise Fund. ENVIRONMENTAL FINDINGS Staff has previously determined that the scope and nature of this Project are Categorically Exempt from the requirements of CEQA pursuant to Sections 15301/Class 1 (Existing Facilities) and as the improvements to the Project do not expand any existing facilities. Existing fencing will be replaced or modified in place. These facilities will be located on the same site as the structures being replaced and will have substantially the same purpose and capacity as the structure replaced and will involve negligible expansion of existing use. A Categorical Exemption was adopted on June 12, 2025 (action item file ID 25-749) LOCAL PREFERENCE Local preference was implemented in the selection process, and the contract was granted to Harris Development Corp dba HBC Enterprises, a local business, as defined by the Fresno Municipal Code. FISCAL IMPACT The Security Fence Improvements at Pump Station 144, 165 and 174 Project is in Council Districts 6, 7 and unincorporated Fresno County, respectively, and has no impact on the General Fund. Funding for this Project is included in the Fiscal Year 2025 Capital Improvement Budget within the Water Enterprise Fund.
