Set the required public hearing at 9:10 a.m. on September 17, 2026 ..Body RECOMMENDATION Staff recommends the City Council adopt the attached Resolution of the Council of the City of Fresno of the intention to vacate portions of city-owned right of way located at the northeast corner of North Milburn Avenue and West Dakota Avenue for Dolores Huerta Park and set the required hearing at 9:10 a.m. on September 17, 2026. EXECUTIVE SUMMARY The Dolores Huerta Park project (Project) will provide 4.5 acres of recreational amenities and landscape plantings. City staff proposes vacating portions of city-owned right of way (adjacent to Assessor's Parcel Number (APN) 511-200-30T) located at the northeast corner of North Milburn Avenue and West Dakota Avenue for Dolores Huerta Park. The proposed vacation of the public street easement is described and shown in Exhibits "A" and "B" of the attached resolution with a reservation of a public utility easement as described and shown in Exhibits "C" and "D". The Dolores Huerta Park project is funded by Proposition 68 and Park Impact Fee appropriations. BACKGROUND The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to expand access to Fresno's parks and open space by developing a new 4.5-acre public park at the northeast corner of North Milburn and West Dakota Avenues. Pursuant to this goal, on June 30, 2022, City Council approved a Consultant Services Agreement with Community Design Works Group (CDWG) to develop construction documents for the project. The new park will include amenities such as playgrounds, multi-use courts, a splash pad, shade structures, seating areas, a skate park, dog park, restroom, and landscape improvements. In addition, the Project will also include roadway improvements including installation of sidewalk, curb and gutter, street lighting, bike lanes, and roadway reconstruction. In March 2025, Council approved the Second Amendment to the Consultant Services Agreement with CWDG for the Project to complete design and construction documents for roadway improvements to provide a safe mode for ingress and egress to the park, as well as through-traffic traveling on Dakota Avenue. In September 1990, Council approved Resolution No. 90-396 dedicating City-owned property for public street purposes along West Dakota Avenue and North Milburn Avenue. A vacation of portions of said Resolution adjacent to City-owned Park parcel (APN 511-200-30T) is necessary for the construction of Dolores Huerta Park and to conform with current Public Works Standard streets, as shown in the Resolution's Exhibits "A" and "B". The Public Works Department, other City departments and utility agencies have reviewed the proposed vacation and determined that the public street easement proposed for vacation is unnecessary for present or prospective public street purposes, as described in Exhibit "A" and as shown on Exhibit "B", subject to the reservation of a public utility easement as described in Exhibit "C" and shown on Exhibit "D", and conditions of approval as listed in Exhibit "E", said exhibits are included in the attached Resolution to Vacate. The City will not be disposing of those portions of land, so the Surplus Land Act is not applicable. City Attorney's Office has approved the attached Resolution of Intent as to form. The vacation, if approved by the Council at the public hearing, will become effective when the vacating resolution is recorded in the office of the Fresno County Recorder, but not until the City Engineer determines that the conditions listed in the attached resolution have been satisfied and accepted by the City. ENVIRONMENTAL FINDINGS A Mitigated Negative Declaration was prepared for the project as Environmental Assessment No. P21-00779, dated March 23, 2021. The Planning and Development Department Director, on June 3, 2021, approved Development Permit Application No. P21-00779 for Milburn/Dakota Park (Park), now known as Dolores Huerta Park, located on the Northeast Corner of West Dakota Avenue and North Milburn Avenue (APN: 511-200-30T). An addendum to Mitigated Negative Declaration (Environmental Assessment No. P21-00779) was prepared for additional improvements to the project and mitigation measures and was adopted by City Council on March 13, 2025. LOCAL PREFERENCE Local preference does not apply because the vacation of a right-of-way does not involve bidding or contracting. FISCAL IMPACT The Project is located in Council District 1. There is no new fiscal impact to the General Fund. The Project is fully funded from appropriated FY2027 Proposition 68 funds and Developer Park Impact Fee funds.
