EXECUTIVE SUMMARY The City of Fresno will be entering into approximately 146 agreements with organizations that were awarded funds under the Cycle Two of the Expanded Access to Arts and Culture (EAAC) Grant Program ranging from zero percent (0%) to ninety percent (90%) of the amounts awarded. In order to facilitate payment of the remaining amounts owed under Cycle Two, the City is in the process of entering into grant agreements and/or settlement and assignment of claims agreements with those organizations that received awards under Cycle Two. The City Manager currently has authority to execute grant agreements in the amounts up to $100,000 and settlement and assignment of claims agreements in the amount up to $50,000. Certain remaining amounts owed to Cycle Two grantees may exceed the City Manager’s existing signature authority. Staff is recommending that the City Council approve the resolution delegating authority to the City Manager to execute agreements of up to $165,000 for Cycle Two of the Expanded Access to Arts and Culture Grant Program. BACKGROUND In 2018 a majority of Fresno voters approved Measure P - the Fresno Clean and Safe Neighborhood Parks Transaction and Use Tax (Measure P), which was thereafter codified in Chapter 7, Article 15 of the Fresno Municipal Code (FMC). Measure P is a retail and transaction tax which requires twelve percent (12%) of the funds collected to be made available on an annual basis to invest in competitive grants for nonprofit organizations that support and expand access to arts and cultural programming. On August 10, 2023, the City of Fresno entered into a Service Agreement with the Fresno Arts Council to administer the Expanded Access to Arts and Culture Grant Program. The Service Agreement was terminated on February 20, 2026. As of February 2026, grantees that were awarded funds as part of EAAC Cycle Two received between 0% and 90% of their awarded funding from the Fresno Arts Council. The City of Fresno has identified funding from the General Fund to fund all awards made under EAAC Cycle Two that have not yet received the total amount of their award. In order to process remaining payments, the City is entering into two types of agreements with Cycle Two grantees; a grant agreement and/or a settlement and assignment of claims agreement. In some instances, grantees receive both depending on the unique circumstances of their award. In all cases, the total amount of the contract(s) does not exceed the total amount the grantee was awarded when Cycle Two awards were approved. The Fresno Municipal Code outlines the City Manager’s signature authority to enter into agreements up to $100,000 for grants and $50,000 for settlement and assignment of claims agreements. Approximately three (3) of the agreements exceed the City Manager’s signature authority. The amount payable to each Cycle Two grantee is based on the award amount previously approved through the Cycle Two grant-making process, less than any amounts previously paid to the grantee. Certain remaining amounts owed to Cycle Two grantees may exceed the City Manager’s existing signature authority. Staff is seeking expanded signature authority of an amount not to exceed $165,000. Increasing signature authority for agreements related to Cycle Two will enable the City to move forward with Cycle Two contracts that exceed existing authorities. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this grant award contract and amendment do not qualify as a “project” as defined by CEQA. LOCAL PREFERENCE Local preference is not applicable. FISCAL IMPACT There is no new impact to the General Fund. Funding for these agreements is reflected in the City of Fresno Fiscal Year 2027 budget.
