RECOMMENDATION
Staff recommends the City Council 1) Adopt a finding of Categorical Exemption pursuant to Section 15332/Class 32 (Infill) of the CEQA Guidelines; 2) Adopt the Resolution finding Good Cause and Clear and Convincing Benefit to the public pursuant to FMC 4-204, relating to the disposition of surplus real property identified as APN 506-010-14T (portion); and 3) Approve the Agreement for the Purchase and Sale (PSA) of Real Property for the City-owned parcel of 4.86-acre APN 506-010-14T (portion) for a purchase price of $1,000 with the Housing Authority of Fresno, and authorize the City Manager, or designee, to execute all documents related to the transfer of the parcel.
EXECUTIVE SUMMARY
The City of Fresno owns the portion of the 4.86-acre parcel identified as APN 506-010-14T (Property). On June 26, 2025, the City Council adopted Resolution 2025-201 declaring the property to be Surplus Land and directing staff to comply with the Surplus Land Act (SLA). In accordance with the SLA process, the City issued a Notice of Availability (NOA) to surplus the property. The Housing Authority of Fresno (FHA) submitted interest in the property, proposing to acquire the Property for the purchase price of $1,000 for the development of an affordable housing project. The proposed development consists of eight multifamily residential buildings with a total of 96 units, including one manager’s unit and 95 affordable units comprising of one, two, and three bedroom floor plans. The units will serve households earning no more than 60 percent of Area Median Income (AMI) and will be deedrestricted for a 55year affordability period through a recorded declaration of restrictions.
Staff recommends City Council adopt a finding of Categorical Exemption pursuant to Section 15332/Class 32 (Infill) of the CEQA Guidelines, approve the Resolution Finding Good Cause and Clear and Convincing Benefit to the public pursuant to FMC 4-204 (d)(4) and FMC 4-204 (d)(5), and authorize the City Manager to execute the Purchase and Sale Agreement, the Grant Deed, and all necessary escrow documents to complete the transfer of the Subject Property.
BACKGROUND
The City acquired Assessor’s Parcel Number (APN) 506-010-14T as part of a larger property acquisition, which included the former APNs 504-090-55 and 506-010-10, to support the construction of a landscape maintenance yard. On May 19, 2000, the City was awarded APN(s) 504-090-55 and 506-010-10 through an eminent domain action for this purpose. Following completion of the maintenance yard design, the Department of Public Utilities determined that the southwestern 4.86-acre portion of APN 506-010-14T (the Property) is no longer needed for use as a maintenance yard.
On June 26, 2025, the City Council adopted Resolution No. 2025-201, declaring the property to be Surplus Land and directing staff to comply with the SLA process.
On July 30, 2025, the City of Fresno issued a NOA to sell/lease the surplus property in accordance with SLA to all interested parties, which included all interested parties from the City’s online subscription system and those listed in the California Department of Housing and Community Development interest lists.
The City received responses from three interested parties, and at the conclusion of the SLA process, staff recommended moving forward with Housing Authority of Fresno’s (FHA) proposal.
FHA submitted a comprehensive proposal for an affordable housing development consisting of 96 units, including one manager’s unit and 95 affordable units: 24 onebedroom, 48 twobedroom, and 23 threebedroom units. The project is designed to serve large families and emphasizes community interaction, safety, and walkability. The site features a loop configuration for efficient access and includes defined pedestrian pathways connecting all buildings, parking areas, community spaces, and ADAaccessible routes. The development will serve households earning no more than 60 percent of the Area Median Income (AMI) and will be restricted for an affordability period of 55 years through a recorded declaration of restrictions.
The project will create 95 deedrestricted affordable units and supports key objectives in the City’s Housing Element and One Fresno Housing Strategy, addressing housing needs, encouraging infill, and investing in opportunityrich areas.
Affirmatively Furthering Fair Housing (AFFH)
Under California Assembly Bill 686 (AB 686), public agencies have a legal obligation to take meaningful, deliberate actions to overcome patterns of segregation, eliminate disparities in access to opportunity, and foster inclusive communities free from discrimination. To fulfill this obligation, the City has committed to prioritize projects that support integration, expand access to opportunity, and reduce racial and economic disparities and that promote inclusive community engagement and equitable development practices across the city. The proposed project is located in an area designated as highest resource by the State Department of Housing and Community Development’s 2026 AFFH Mapping Tool. The project proposes 95 units of lower income to moderate-income housing along with a manager’s unit. The project is consistent with AB 686 because the project adds to the mix of housing types and affordability levels in the area, creating mixed-income neighborhoods and increased opportunity. Therefore, the project is consistent with the Housing Element’s AFFH goals.
Better Business Act (BBA)
The BBA does not apply because City’s indirect subsidy is estimated to be $180,000 based upon an appraisal of this parcel that was completed in June 2023, which less than the $1,000,000 BBA threshold.
ENVIRONMENTAL FINDINGS
Staff performed an environmental assessment for this project on June 2, 2026, and determined this project is exempt under Section 15332/Class 32 of the California Environmental Quality Act (CEQA) Guidelines and that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2, apply to the project.
LOCAL PREFERENCE
Local Preference does not apply to the sale of Surplus Real Property to the Housing Authority of Fresno.
FISCAL IMPACT
The sale of the property will have a positive fiscal impact by generating $1,000 in revenue for the City’s General Fund.
