REPORT TO THE CITY COUNCIL FROM: JENNIFER K. CLARK, Director Planning and Development Department BY: NADIA SALINAS, Project Manager Planning & Development Department SUBJECT ..Title RESOLUTION - Amending the Community Benefits Fund and Expenditure Plan Guidebook to establish Phase 4 and expand eligibility for the Reyes Coca-Cola Bottling Company (RCCB) project. ..Body RECOMMENDATION Staff recommends that the City Council adopt the proposed Resolution amending the South Central Community Benefits Fund and Expenditure Plan to update the existing Guidebook to include Phase 4, which expands eligibility to County residences located within a onemile radius of the Reyes Coca-Cola Bottling Company (RCCB) project and clarifies award limits for previously funded properties, consistent with the criteria described in the Resolution. EXECUTIVE SUMMARY On March 30, 2023, the City Council approved Development Permit Application No. P2200565 for the Reyes Coca-Cola Bottling Company project with the condition that $300,000 be contributed to the City’s Community Benefits Fund (CBF). The Community Benefits Fund guidelines were adopted on February 9, 2023, and amended on October 31, 2024, and March 27, 2025. The proposed Resolution further amends the CBF and Expenditure Plan by establishing Phase 4, which expands eligibility to County residences located within a onemile radius of the Reyes Coca-Cola Bottling (RCCB) facility. Phase 4 applies only to residences that have received zero or one award to date, ensuring that no residence receives more than two total awards from the CBF. If adopted, eligible residents may apply for up to $8,000 to complete qualified mitigation improvements addressing impacts such as air pollution, traffic, noise, and light spill. Phase 4 is intended to distribute remaining funds equitably and conclude the RCCB funding cycle. BACKGROUND On March 11, 2021, the City Council approved a settlement agreement requiring the creation of a Community Benefits Fund (CBF) to mitigate developmentrelated impacts on sensitive receptors and local communities. The settlement also required the City to develop program guidelines in consultation with South Fresno Community Alliance, Leadership Council for Justice and Accountability and other stakeholders, including Orange Center School. On February 9, 2023, the City Council adopted Resolution 2023027, establishing the Community Benefits Fund and Expenditure Plan to fund qualified mitigation improvements for properties within and immediately adjacent to the South Central Specific Plan (SCSP) boundaries. On March 30, 2023, the City Council approved Development Permit Application No. P2200565 for the Reyes Coca Cola Bottling Company project, requiring a $300,000 contribution to the CBF. The City has received payment in full. Subsequent amendments expanded eligibility boundaries to 0.75 miles (Resolution 2024260) and later to 1 mile specific to the RCCB project (Resolution 202579). Despite these expansions, additional eligible properties remain outside the current radius, and further expansion is necessary to ensure equitable access to remaining funds and to address continuing developmentrelated impacts. The proposed Resolution establishes Phase 4, expanding eligibility to County residences located within a onemile radius of the RCCB facility. Phase 4 applies only to residences that have received zero or one award, providing a final opportunity for eligible households to participate before the RCCB funding cycle is closed. Between April 30, 2025, and September 1, 2026, mailers, flyers, and certified letters were distributed to residences within the initial onemile boundary in the City and the 0.5mile and 0.75mile boundaries in the County. Outreach efforts included doortodoor visits, followup mailers, and multiple notification rounds consistent with the CBF Guidebook. To date, 11 reimbursements totaling $76,000 have been issued, completing Phases 1–3 for the 27 residences within the original program area. Expanding eligibility through Phase 4 will allow remaining funds to be distributed equitably and support completion of the program. ENVIRONMENTAL FINDINGS This approval is not a project for the purposes of CEQA Guidelines Section 15378. LOCAL PREFERENCE Not applicable FISCAL IMPACT Funding is provided solely through the developer deposit established in the settlement agreement. No impact to the General Fund.
