RECOMMENDATION
Staff recommends the City Council approve the Third Amendment to the Consultant Services Agreement with Provost & Pritchard Engineering Group, Inc. in the amount of $76,243, bringing the total contract amount to $1,755,134, with $33,609 of remaining contingency, for additional professional engineering services required for the design of plans and general construction documents for the River West Eaton Trail Extension Project and authorize the Capital Projects Director or designee to sign the Third Amendment to Agreement on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno (City) and Provost & Pritchard Engineering Group, Inc. (Consultant) have been progressing with the design of the River West Eaton Trail Extension Project (Project). As the design progresses in the Construction Documents (90% design) phase, it has been identified that a means of accessible pedestrian connection from the Palm Avenue public street right-of-way to the Palm Avenue trail access is needed beyond the original scope of the Consultant Services Agreement (Agreement). The City desires to amend the Agreement to include the additional professional services needed to design and incorporate the accessible pedestrian connection into the construction documents. The Project cannot proceed to construction without the additional scope as the Project needs to serve all pedestrians regardless of any disabilities.
Staff recommends the City Council approve the Third Amendment to the Consultant Services Agreement with the Consultant in the amount of $76,243, bringing the total contract amount to $1,755,134, with $33,609 of remaining contingency, for additional professional engineering services required for the plans and general construction documents for the Project. The Project is funded by the State of California Wildlife Conservation Board (WCB) Implementation Grant Proposition 40 and Proposition 68 funds, and Planning Grant Proposition 84 funds. All project costs for the preliminary engineering (PE) phase will be paid by WCB's Planning Grant Proposition 84 funds.
BACKGROUND
In 2018, the San Joaquin River Conservancy (SJRC) updated the San Joaquin River Parkway Interim Master Plan (Master Plan) that was originally adopted in 1997. The updated Master Plan describes public access and recreational improvements along a 22-mile stretch of the San Joaquin River between Friant Dam and State Route (SR) 99. The 2018 update provided a plan to guide future improvements that would improve public access and recreational facilities in the area located along the south side of the San Joaquin River just north of Bluff Avenue, between SR 41 and the City's Spano Park. The Project will provide increased public access to the San Joaquin River for all residents of the City and visitors to the area.
The Project has been divided into two phases for construction due to funding limitations. Phase 1, known as the Core Project, includes the addition of approximately 2.4 miles of multipurpose trail from the Perrin Avenue alignment near SR 41 to the City's Spano Park at the northern terminus of Palm Avenue, a new vehicular access point at the east entrance ("Woodward West"), access for pedestrian and bicyclists from the City's Spano Park, and sidewalk improvements at the SR 41 undercrossing at Perrin Avenue to connect to the existing Lewis S. Eaton Trail network at the City's Woodward Park. The Core Project will also include new fire hydrants; one two-vault restroom at the Woodward West access; other amenities such as lighting, picnic areas, gates, and signage; and habitat restoration and revegetation. A future Phase 2 of the River West Eaton Trail Extension Project will add two additional vehicular access points, a bus turnaround with access roads, a second two-vault restroom, and other trail amenities.
The City originally entered into an agreement with the Consultant for professional engineering services on September 29, 2022 for a total fee of $1,650,000 with $62,500 in contingency. A First Amendment to Agreement was executed on September 22, 2025 to revise the scope of services to add the preparation of an Administrative Draft Addendum to the certified Environmental Impact Report (EIR) for the Project. The compensation for the revised scope of services described in the First Amendment is $14,990 from contingency, which increased the total contract amount between the City and the Consultant to $1,664,990, leaving $47,510 remaining in contingency. A Second Amendment to Agreement was executed on June 12, 2026 to revise the scope of services to add soils testing of the stockpiles on project site APN 402-030-71ST as required by the Fresno County's Environmental Health Division. The compensation for the revised scope of services described in the Second Amendment is $13,901 from contingency, which increased the total contract amount between the City and the Consultant to $1,678,891, leaving $33,609 remaining in contingency.
As the design progresses in the CD phase, it has been identified that a means of accessible pedestrian connection in addition to a stairway from the Palm Avenue public street right-of-way to the Palm Avenue trail access is needed beyond the original scope of the Agreement. The City now desires to amend the Agreement to include the additional professional services for design of accessible pedestrian connection and authorize the Capital Projects Director or designee to sign the Third Amendment to Agreement on behalf of the City.
The Project is funded by the State of California Wildlife Conservation Board (WCB) Implementation Grant Proposition 40 and Proposition 68 funds, and Planning Grant Proposition 84 funds. All project costs for the PE phase will be paid by WCB's Planning Grant Proposition 84 funds.
The City Attorney's Office has reviewed and approved Third Amendment to Consultant Services Agreement as to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, the award of this contract does not qualify as a "project."
LOCAL PREFERENCE
Local preference was not implemented because this item does not include a bid for or award of a construction or services contract. This is an amendment to an existing services contract.
FISCAL IMPACT
The Project is within Council District 2. This request will have no impact to the General Fund. All project costs for the preliminary engineering phase will be paid by WCB's Planning Grant Proposition 84 funds. All funds necessary for the Third Amendment are included in the current fiscal year budget as previously adopted by City Council.
