REPORT TO THE CITY COUNCIL September 21, 2017 FROM: PAUL CAPRIOGLIO, Councilmember Council District 4 SUBJECT ..Title BILL - (For introduction) - Amending subsections (b) and (i) of Section 6-205 of the Fresno Municipal Code relating to collection and disposal regulations ..Body RECOMMENDATION Amend subsections (b) and (i) of Section 6-205 of the Fresno Municipal Code relating to collection and disposal regulations. EXECUTIVE SUMMARY The proposed amendment states any unauthorized collections from carts/bins or roll-offs may be prosecuted as a misdemeanor. BACKGROUND The City has issued 414 citations for recycling theft, resulting in $484,700 in fines, though the amount of fines collected has not been verified. Many of these violations are believed to be perpetrated by repeat offenders. ENVIRONMENTAL FINDINGS By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a "project" for the purposes of CEQA. LOCAL PREFERENCE N/A FISCAL IMPACT There is no estimated additional financial cost to prosecute these violations as misdemeanors. The estimated value from the City Attorney's Office for prosecution is $20,000 annually, but the function will be performed by the City's current municipal prosecutor, and will not create an additional cost. A portion of the cost to prosecute may be offset by fines collected. Attachment: Ordinance
