Award a Construction Contract with Witbro Inc. dba Seal Rite of Fresno, California in the amount of $84,653.00 for the Installation of Sidewalks and High Visibility Crosswalk at Ezequiel Balderas Elementary School. EXECUTIVE SUMMARY In 2011, the City was awarded a grant under the Federal safe route to school program to provide a safe walking route for the students attending Ezequiel Balderas Elementary School. The scope of the project includes construction a 940' asphalt concrete walkway on the north side of Florence Avenue west of Chestnut Avenue and installation of wheel chair ramps and high visibility crosswalks at the intersection of Chestnut and Florence Avenues. BACKGROUND In 2011, the City was awarded a grant under the Federal safe route to school program to provide a safe walking route for the students attending Ezequiel Balderas Elementary School. The scope of the project includes construction a 940' asphalt concrete walkway on the north side of Florence Avenue west of Chestnut Avenue and installation of wheel chair ramps and high visibility crosswalks at the intersection of Chestnut and Florence Avenues. Public Works Department staff prepared general construction documents for the project and a Notice Inviting Bids was published in the Business Journal on April 14, 2014, and posted on the City's website and faxed to ten (10) building exchanges. The specifications were distributed to five (5) prospective bidders. Four (4) sealed bid proposals were received and opened in a public bid opening on May 6, 2014. Bids ranged from $55,693.50 to 96,520.00. Bid submitted by Marko Construction Group, Inc. of Fresno, California in the amount of $55,693.50 and was determined to be non-responsive for not submitting DBE information within the time stipulated in the bid document. The second lowest bid in the amount of $84,653.00 submitted by Witbro Inc. dba Seal Rite was determined to be the lowest responsive and responsible bidder for the project. The bids will expire in 64 days from of the bid opening date on July 09, 2014. Staff recommends that the Council award a construction contract with Witbro Inc. dba Seal Rite of Fresno in the amount of $84,653.00 for the Installation of a walkway and high visibility crosswalks at Ezequiel Balderas Elementary School as lowest responsive responsible bidder and to authorize the Public Works Director or his designee to sign and execute the standardized contract on behalf of the City of Fresno. ENVIRONMENTAL FINDINGS Staff has performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemptions set forth in Sections 15301 and 15332 of the CEQA Guidelines. The Categorical Exemption Section 15301 applies to projects involving a negligible or no expansion of an existing facility. This project involves improving efficiency and the safety of an existing street by constructing a walkway adjacent to the existing travel way to separate the pedestrians from the vehicular traffic. Additionally, the Categorical Exemption in Section 15332 applies as the project is constructed with all applicable General Plan zoning policies, it occurs within City limits on a site no more than five acres, surrounded by urban users, the site can be adequately served by utilities, the project will not result in any significant effects resulting to traffic, air, noise, or water quality and the site has no value as a habitat for endangered, rare or threatened species. Staff determined under the CEQA Guidelines this project fits within the definition of existing facilities in Section 15301and 15332, as Categorically Exempt from further CEQA review. Furthermore, Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. LOCAL PREFERENCE The local preference was not implemented based on conditions of the Federal Safe Route to School program grant. FISCAL IMPACT The project is located in Council Districts 5. The overall cost of the project is $124,900 and is funded by $103,900 grant from the Federal Safe Route School program and $20,300 Local Pedestrian and Bike funds. The project will not have any impact to the General Fund.
